Do i have any legal rights after being attacked and threatenedto be killed by a team

    I don't think any lawyer would take this case.Sounds too weak to defend.

    States are different. Like here where I live if someone assaults you, you can go to the courthouse and swear out a warrant on them. They get arrested and all parties show up in court. Only if an officer sees the actual assault will they intervene. Since you both live in the truck I don't see why it couldn't be classified under domestic violence?

    Then there's the civil lawsuit end where you file a case and sue them for damages like medical bills, pain and suffering and any other damages. But you have to prove your case with documentation like arrest report, medical bills, etc.

    Each state has statutes of limitations like 1-5 years on civil matters. The longer you wait the less weight your case bears. Each state is different and you need a lawyers advise depending how far you want to take it.

    The guy definitely has issues. The employer should of intervened and fired the guy.

    After getting (virtually) nowhere with local law enforcement, that would have been my 2nd call. I know that the chemistry between two people is important when you are sharing a truck. The other guy has some serious issues. Wonder how many other partners he's had?

    You folks are going on and on about something that has now become; ones word against another!

    OP clearly stated (or inferred) that there was no evidence gathered (pictures, witness statements from the highway, or a police report, or even any attempt to call LEO) AT THE TIME OF THE ASSAULT, or within a legitimate time frame to establish a case. [Bruises, split lip, marks on the throat]. Plus in the opening remarks, she was at the company terminal when the assaulter showed up...yet she ran and hid in the bathroom, without pursuing any action with the company with other people there to keep her safe. Obviously the company did not buy into her claims...plus the story is not realistic if you would take a bit of time and re-read, slowly, through the opening statement on this thread.

    Even the slickest and/or dirtiest lawyer would not attempt this case on a civil basis, nor would any DA give this enough merit to even investigate!

    Why would he need defense ? He was a victim .
    Nothing has been said about the carrier this O/O was leased to . They are responsible for the actions of their trainers . A lawyer might be interested in a suit against a megacarrier .

    The OP [original poster] needs to learn some basic self defense. Get some dvd's on self defense from places like www.BlackBeltMag.com, www.Espytv.com, www.Paladin-Press.com etc. If he was close enough to put his hands around your throat, then he was close enough to put your own choke hold on him such as Jiu Jitsu standing double lapel choke. Eagle Claw kungfu or Pencak Silat would also straighten the attacker out.

    . Let me make it perfectly clear. I do not advocate anyone start a physical confrontation. However, if I have to defend myself from a physical attack, there is only one rule: Do not lose. I will do whatever it takes. Enough said.

    If someone assaults me, or a family member, or anyone that I happen to witness, the cops are being called RIGHT AWAY and pictures will be taken IMMEDIATELY. It's just stupid to wait 3 freakin weeks! Now the damage is probably healed up and you can't call the cops because they'll ask why didn't you call 3 weeks ago, so you don't even have a police report or any good pictures. I'd probably just let it go. Basically if you take him to court, he'll deny it and they will ask to prove it was him who did it. Kind of hard at this point.
