Question about "Log book" ticket in Calif.?

    supergreat 10 - what exactly was the log book violation written for? Not up to date, tampering, overhours, what? While it's probably not a great idea to update your log at the scales, there is nothing illegal about if the truck is stopped. The antelope scales were bad 25 years ago; once saw a truck sitting there with a steer tire and wheel removed and locked to the tractor.

    If you cross state lines..it's considered interstate commerce and logbook is required.

    (I am assuming you received a log book ticket for not having copies of your Record of Duty Status for the previous seven days.)

    Carefully read the questions and answers that pertain to 395.1(e):

    -Interstate drivers are NOT excluded from the 100 air-mile radius rule. You can cross state lines as often as required provided you don't violate the provisions in 395.1(e).

    -You are not required to have a record of hours worked in your possession. Your employer, however, must produce your time records within 48 hours if requested by law enforcement. The exception to that rule is when your current workday will exceed 12 hours or 100 air-radius miles. You will have to have a log book sheet with duty status current in that case.

    It's cut and dried. I think you have a good case, provided your log sheet was current. Plead not guilty and post the bail.

    No, it is not required to have a logbook, as long as you stay within the 100 air mile radius, per FMCSA.

    My company did a air milage on the internet a few years ago and like one person said its about 116 miles. I use to be a HOT head but a long time ago I learned to control myself & everything is yes sir now! thanks for your reply! Has anyone ever been to a calif court on something like this???

    No I had copies of my last seven days infact the whole month. Plus I just got done with a 4 day vacation which I logged everyday! For some reason this officer was either on a power trip or someone else pissed him off & he was using me to get even! By grabbing the book out of my hand before I got to the office door plus to be waiting for me when I came around my trailer says something was wrong.

    Not up to date for the last ten minutes which I did do while in line waiting to cross the scale so it was current

    This scale is NOTHING but trouble! 90 percent of the time its closed when I come back! years ago they were usung this place for a training place & on my short trailer we had one of those poles in the front of it that you can use to keep the trailer from tipping over when there is no tractor hooked to it! & three of the officers at that time had NO idea what it was for & wanted to write me some ticket for that BUT a head officer understood what the pole was for & they let me go

    WHY? The regs state your log is to be up to date to the last change of duty status! That would mean when you left the last location and started driving again.
