Out of hours, but forced to leave property after loading.

That's royally messed up.Its like you're ###### if you do ###### if you don't.That customer could have let you stay there.Afterall they took too long loading you.If your company gives you a warning for this,ask them what should I have done,they took too long to unload me so why is it my fault..The officer didn't issue you a ticket so you'll probably be fine with your company.If you have another situation like this,call your company a couple hrs before you're out of hrs and ask them what to do.

 

I've worried about situations like this happening to me when I get out there, lol. Unless I'm mistaken though, this really seems like something you should have called your dispatcher about ahead of time, before your HOS were up.

 

The only thing you could have done is after not bein loaded in a couple of hours as expected. Send message in and follow up with phone call to your dispatch. This puts the ball in thier court. Maybe they could call shipper and speed things up or make the decision to drop trailer or pull you out all together and come back.
You have little to stand on when the company does not know what the situation is until after the fact. Let them share in the responsibilty.

 

How can a company not allow you to do a 2/8 split in the sleeper? You do what you have to do in order to get the job done...If I get to a shipper/receiver, I may log 15 mins on duty and then immediately go to sleeper

3 more hours and you can have a 8-2 split. And yes, it's bad trip planning. Refuse the load if it'll take you that long to get to the shipper. You likely dont get paid for deadhead anyway.

I don't need to tell Swift anything. They aren't the FMCSA, and I don't work for them (thank God). Regulations state that only time worked gets put on line 4. Do what you log and log what you do. If your butt is in the sleeper, log line 2.

 

No, I'm saying it would be more reasonable to refuse the load. If you're driving for a bottom feeder, it doesn't make any sense to deadhead 4+ hours to get to a shipper when nearly all bottom feeders have a rather large customer base for one, and you don't get paid for deadhead for two. And yes, the driver is to blame for. Not the company, not the customer, not the bosses dog, etc. Your screw up, live with it, learn from it, and move on.

 

Just a FYI,

Just because you violate HOS regs with a Qualcomm doesn't automatically conclude you're getting CSA points.

To the op, I had this happen on elogs once. Showed to a shipper with 5 hrs on my 14 for a drop and hook. They changed it to a live load then proceeded to take 6 1/2 hrs to do it then throw me off the lot. I found a parking spot but it did put me to driving on the computer. The next morning my dispatcher messaged me for an explanation. I told him what happened at thats the last I heard about it. Hope your luck is the same.
