Truck order not used?

    Hi, I need some advice.
    I've booked a load about 170 miles away, broker was aware of this. One I came to pick up, shipper tells me that the load has been picked up by someone else.
    long story short. I came to shipper around 6pm, load was booked at 12pm. Broker told me that evening that he will pay me at least $350, that we'll talk in the morning about all that, i was like, ok.

    So morning comes, I call him and he says that he needs to put a request in for truck order not used and wait day in a half. Im like WTF?! Its brokers responsibility to pay me truck order not used, and then if he needs to he can go and take it out of the customer. and he tells me, that he doesnt even have to do any of this for me, the request for truck order not used. he pretty much is saying that if he wants to, he will pay, if he doesnt want to he wont.

    What can I do here. Can I go to court, or insurance bond?

    no there nothing you can do. your a business and he is a business. sometime you take losses. best bet is to forget about it.

    do like I did before; book another load with him for more than u would haul it for to recoop ur expenses

    Your mistake was saying "WTF?! Its brokers responsibility to pay me truck order not used, and then if he needs to he can go and take it out of the customer. and he tells me, that he doesnt even have to do any of this for me, the request for truck order not used." There is no legal requirement for them to pay unless you had it in a contract. Basically don't piss um off and they might pay.

    You sometimes do have losses, but keep track of the bad ones. Put them on a never do business with list.

    It's a very rare occurrence but it does happen. If a customer does that to us more than once we don't move freight for them anymore.

    We try to get the TONU from the customer but they don't often pay it so we either pay it out of pocket or book another load and add it to the rate so everyone makes a little money.

    We never issue a rate confirmation with TONU on it for one simple reason. If a driver has to sit beyond normal detention hours they often want some crazy amount when in reality they were going to break anyway. We always try to be fair but when someone makes an unreasonable demand we have to fall back on what's legal and we don't do business with that driver again.

    On the other hand we have some great customers that are willing to pay what is owed and never make a sound about it. We don't abuse these guys because we like doing business with honest people. We usually charge between $250.00 - $350.00 depending on how far the truck had to deadhead and pay it all to the driver.

    If he dosen't pay you TONU, file on the brokers bond. They will pay up quick. Ofcourse that means no more future loads with them. It could be an honest mistake or he used found someone cheaper to move the load with.

    First, you cannot file on a broker bond for a truck order not used. If you have no written agreement, there is nothing the driver can do about but take his losses and not work with the broker anymore. It's live and learn pretty much.

    If there is no contract that says they will pay you for the truck order not used, there is really nothing you can do. It would cost you more for court cost and the broker's surety bond will only call the broker and check to see if there is a clause in the contract that states they will pay you. Best to take your losses. We are a broker and there is nothing in our contract that says we have to pay you a truck order not used if the load cancels. We pay out of respect for the driver.

    You're screwed. Your load was probably being peddled by 5 brokers, four of them sending trucks in willy nilly to pick up a load that the first one got. Next time, call shipper before you move....and even then you're rolling the dice. Post broker's name and location and MC# in the Bad Freight Broker thread here so we all know who we're dealing with.
