I'm done with this thread. Like I said, I've got mine and only work part time so I don't care what happens because it will have little effect on me. Sure hope you guys don't end up wishing you wouldn't have participated in this. I never have believed all those rumors about WalMart getting rid of the private fleet. But, stuff like this here could bring it about. I'm not saying you are not right.......just saying a law suit is not the way to correct it in my opinion.

The private fleet cant expect to attract the best drivers if they are going to treat them like rookies,the best drivers in the industry are what have always made the private fleet a big deal. Now the best are going to stay put where their at and the fleet will soon be made up of drivers that ten years ago would have never been considered. If you set aside the wages its really headed the way of all the other mega fleets. Some just dont get it.TomOfTx Thanks this. -

As professional drivers for the private fleet we are asked to adhere to some very high standards,obeying all laws applicable to our positions is a big part of what we do. Why should Bentonville not be held to at least the same standards?
Even with a win for the drivers here in CA the costs to make things right would not equal anywhere near what ceasing opperations of the CA DC's would be. Walmart has a huge financial interest in both infrastructure and real estate here in CA,its not just GM DC's. Servicing this market from outside the state would be a logistical nightmare and third party operations when needed have struggled to provide the level of service our stores expect. Now if the recent past is any indicator the morons in legal might fancy the idea just for retaliation but Im sure there will be settlement language to cover such action,CA private fleet operations will survive intact.
Our legal action like Tom said is based around CA employment law,however a win for the drivers here would surely set precedence and could well be used as an arguement in other courts. Just picture Bentonville having to bear the cost of retaining legal teams to fight long drawn out battles in courts across the country. There is no doubt that legal eyes are on our case and other actions are almost unavoidable. There are way to many drivers that would love to see some justice for past deeds done and alot that are just plain pissed off.
Bentonville needs to take the high road and settle with all the private fleet drivers in all states. A lump sum up front based on a drivers service and a guarantee of 100% compensation for all duties going forward will in the long run prove far less costly compared to big pay outs that could be ordered by courts across the country. Using some simple math based on a 5/2 set run this extra pay would add 75.00 give or take a liitle to the average drivers ADP. Is that really a number that would threaten the financial stability of Walmart? -
you can't wait to leave whatever job you have to get to Walmart then that isn't good enough!!!!!!!!!!!!!!!!!!

With all the hiring going on Im sure its generating alot of traffic on this forum. I would hope that anyone considering a move to the private fleet would take the time to look over and learn more about this case against the private fleet.
This is not a case about one drivers "sour grapes" or a drivers last resort to win his job back. This is a full blown class action lawsuit involving as many as 900 drivers. The court saw enough merit that they ordered Bentonville to release the names and contact information of all drivers involved. That is huge and Bentonville is less than happy,they dont like being told what to do.
You might ask how can this affect me,Im going to apply out of CA. Well driver if the court sides with us you can bet other cases will begin to enter courts all around the country. Of course Walmart may settle in our case and then make policy changes that will benefit all private fleet drivers. Then again in typical Walmart fashion they may just see the cost to much to bear and take evasive action.

Keep crying and filing lawsuits for all your unpaid time and you will end up like a friend of mine who has driven for Kraft foods for 18 years. They were just informed a few weeks ago they no longer have a job. The kraft private fleet is going by the wayside. Companies like Marten and other refer carriers will be pulling the Kraft now.

Let me educate everyone on how things work behind the scenes at Walmart. This company already sub contracts a majority of its truck load freight. DC to store freight is just a drop in the bucket,there is so much more. For example SNL,Swift,JB Hunt and others move all the inbound store freight from ports on the water and rail heads to DC's around the country. Inbound DC freight is hauled by the private fleet in some areas but its usually local suppliers. There are also several outside logistics companies that operate unmarked DC's all around the country for Walmart. These DC's load out consolidated freight for the local and regional Walmart DC's . There are huge center point consolidation operations that put together loads that move to DC's across the country. No private fleet drivers move long haul OTR freight,if we did it would add thousands of private fleet jobs. Bentonville has their hands full filling the seats now.
Kraft has been contracting out the majority of their work for years. There are 285 Kraft drivers that are having to find new jobs, thats roughly a third of the number of drivers involved just in the CA action. Kraft is offering up all kinds of help including financial assistance. These guys are hardly being kicked out onto the street because they stood up to their employers unfair labor practices.
When you hear the private fleet guys make comments like "contract carriers cant service our stores like the private fleet" their partially right. The outside carriers they are speaking of are in most cases last minute "purchased transportation" and are usually not the drivers employed by the big third party logistics companies. The companies that operate DC's delivering freight to the stores are run much more like the private fleet. These third party logistics companies could easily take over any of our existing DC's and service the stores,they have been doing it for years.Last edited: May 22, 2014
