40 pounds over on trailer axles do you return to shipper to get re-adjusted .. again?

Scenario is this. It's been an all day affair of getting weighed and reweighed. Going back to the shipper to get the load adjusted and they say just slide the fifth wheel forward. Slid forward doesn't do sh** for the trailer axles. Go back and get weighed, same issues. Tandems are slid back to the max they can go to be legal. Went back to shipper again, this time they finally adjusted the load. Went back and got reweighed, now I'm only 40 pounds over on trailer. Once again, I'm at the max of everything that I can adjust, only way to fix... a measly 40 pounds is to go back to the wonderful shipper... again. They're tired of seeing me, I'm tired of seeing them, 6 miles to scale and 6 miles back is getting ridiculous. I know everyone by name now.... My trainer says to go back and get it adjusted, I'm thinking yea, you go ##### do it then. He's been in the sleeper for over 26 hours now!!

What's the verdict? Do you lose your license, and get a bazillion kagillion dollar fine from dot if you're just 40 pounds over weight on one axle??? Or does my trainer have his head waayyy to far up his #####? I'm soooo tired....
