    WOW is right, time stamp on text should have proven he was texting while driving, sad day this for the two women and their families

    I don't think there was any denial that he was texting while driving. The defense argument was that the fact that receiving a text at 12:51 doesn't mean he was reading it at 12:52 when the crash occurred.

    Also, from what I heard, the police expert testified that the times of the texts cannot be relied upon.

    Either that judge was clueless or the driver had a really good lawyer. I wish that lawyer practiced law here. If he could get a driver off the hook from killing two people imagine what he could do to a speeding ticket.
