Off duty driving- privilage or law ?

    Every comapany interpreting ODD as they wish - Question is : long houl drivers are privlaged to use ODD during reset or is the law or regulation that we were provided this option from FMCSA being away from home ? My company deleted this option from my e-log and my reset is in big dudu . Did they have a right to do this or they broke the law ? Thank you , please help :)

    FMCSA publishes regulations to be followed if personal conveyance is being used. There are no regulations requiring a company to allow its drivers to use personal conveyance; that is subject to company policy.

    Thank you very much , the big question is ; if FMCSA developed e-log units with it's programs of HOS and all of them has the option OFF DDRV .in my eyes they provided the option of using CV for private use to be legal and do not affect your reset hours. So , now look like it's been provided to the companies - not us ? They can do with it as they please ? Thanks again .
    p.sThis is my first post , if there are any mistakes , sorry but solo woman with this treatment , is just stresful.

    Until you own the truck, it is a privilege.
    Off duty driving means you are using the truck as a personal taxi. Some companies will allow this. Some won't.

    If you're loaded it is not even an option if you do own the truck.

    Thanks miss elvee , bobtailed to the hotel from yard and back , that's what lack of ODD in the unit affected my reset - it jumped right od driving . i am not company driver , OO but driving for buddy from our company while waiting for my new truck.Was logged OFF Duty .

    Have you called the company, they can fix it for you.

    They MAY not want to, but it is possible. :D

    Thank you for help :) No , they don't want to change that it's broker's truck. Trying to find out if , by deleting this option from unit , they broke the law. Never had such a problem and used to love e-log , but with them ? it's horrible , they asked me to send the hotel bill !??!?! i am not fresh in the company - 3 years driving for them.???? Husband if off due to medical and now this...did they have a right to delete ODD from unit ? anybody ? tnx

    So you think its unfair. Please explain the exact conditions in which you can. Nothing says anyone You work for can not make the guidelines more restrictive according to how they want you to run the truck. Plenty of places where I have worked do not allow this type of driving. If they say you can't and they still offer the option under elog and you do it anyway your fired. Simply because you broke company policy.

    As you can read its very restrictive to use a vehicle for conveyance there is no off duty drive time in the regulations. To play it safe most companies will tell you they do not allow it. Under normal conditions for the majority of the fleet they are never going to qualify to use it. The small percent are just going to suffer.

    No laws were broken by denying the use of the personal conveyance provision.

    The FMCSA did not develop the e-log device and the programs therein in your truck; they publish regulations for how they must operate and their use.

    If you didn't know the carrier's policy and/or the company or owner neglected to inform you, then that's unfortunate, but you will know for next time.
