Once again.What does failure to maintain a lane of travel even have to do with someone SAFELY moving over to allow someone to merge.Please note the now capitalized word SAFELY.

ok what part of (1) A vehicle shall be driven as nearly as practicable entirely within a single lane and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety;
what part of bold isn't clear...if you move from one lane to another or merge into traffic and end up hitting someone then one didn't do their movement safely...therefore failure to maintain lane applies. also note that if an officer see's you moving and feels or thinks that you moved over as to cut a driver off can be also deemed as failure to maintain lane.
