Was Mandatory 30 repealed?

    Some driver posted up and said something about a superior court judge repealing the 30 min break law back in August. Was that driver talkin out his ATA ?
    He said the law was repealed because it doesn’t make sense that a local driver would gain any benefit from a 30 min break, which actually makes sense (just makes the day longer)!
    Haven’t found anything about this with google and cant remember what member posted, or what thread for that matter. Anyone?

    I'm pretty sure it's still in effect. In fact, one of our drivers recently got nailed at a LA scale for not showing a 30 minute break on his log.

    Im just reading a lot of here say, one hand says "they have 52 days to petition for a re-hearing, but Im not finding anything that looks factual. 52 days is up, is all I know, lol.

    Yeah I gather that its the pencil pushers not enforcing it (if its even true), and the DOT guys in the field will likely keep cashin in until they are actually prohibited from it, lol.

    30 minute break is required IF you are required to keep a RODS.

    Local drivers who fall under the 100 air-mile radius exemption are also exempt from having to take the 30 minute break. Besides, without a RODS that shows 30 minutes off duty, how would you be able to tell if it had been taken or not?

    There are some other exemptions and exceptions to the rule...but for the most part, if you are OTR, you probably need to be taking the 30 minute break.
