Is it a crime to lie about a prior positive drugs test?

    It might be not illegal upfront, but if you are ever involved in a serious accident and you are implicated in it, everybody will find out. You could possibly be in legal trouble at that point, for not disclosing a history of 'substance abuse.' By the way, a fatal accident might happen when you least expect it and might not be your fault at all. If that's a risk you want to take... but first thing, check your DAC. If it's not on there, go from there.

    Answer the question as asked... If it asks if you have ever failed one... Yes you have, if it asks have you ever failed a DOT one, no you haven't.

    Some states do have a law making it a crime to falsify an employment app. A misdemeanor level violation.

    FL is one. Previous employers are only "legally" allowed to answer yes or no, whether you worked there or not, and yes or no whether you are eligible for rehire.
    That doesn't mean that there aren't employers who say more than this. The "trick" is to prove that they did; you can sue them for defamation even....... IF you can prove it.
