Car rear-end my Trailer!!!

    So your saying a car damaged the crossmembers of the tandem? the same tandem thats about 4 feet in front of the DOT bar? Where you hit in the tires as opposed to being rear-ended?

    I think she was texting and driving. My trailer has complete DOT reflecter strips, all rear lights were on at that time .Her car was total loss. Its take one week to order the buck plate and another 2 weeks to repair including change the buck plate, 11 cross members, sliding rail, flatness the duck floor. Dot bumper.

    Even my insurance company said the auto insurance will not pay for the downtime, too. If they said so, what should i do? My first time in this situation.

    Get the rental , ASAP , and get back to work. You will get reimbursed for the rental regardless of what her insurance Co says.

    Get YOUR agent involved. That's what you pay them for. Let them make a call on your behalf. If that doesn't get satisfaction , go see an attorney. A simple letter from an attorney gets those scam artists attention really quick.

    It'll probably cost you $300-$400 for the attorney but you can recover that ,too in the settlement because they FORCED you to take that measure.

    It's their job to say no and to save THEIR company money. They couldn't care less about your vehicle.

    ^^^What he said. Get the rental asap. And I'd go ahead and see a chiropractor about some neck pain. If they want to play hardball then go for it, might as well add some pain and suffering in there as well.

    Always go to the hospital in ambulance. I have been told you have a 90% better chance of getting down time /lost revenue.

    I had a 4 wheeler pull out of a driveway on me, on a 2 lane rd. I was doing 55mph... I totaled the 4 wheeler but, he was ok. State Farm paid for my downtime. Over a month of downtime....they even overpaid me for a day(like 4xx a day) I let them know....they said keep it.

    Wow 3 weeks? I got rear ended by another semi truck, total his truck and only bent my bumper! Must be an American made 4wheeler right?

    About 15 years ago,I was rear ended,sitting stopped at a traffic light in Va.Honda car crashed into the back of my Trail King lowboy,witnesses and police est. said he was going at least 50,never touched his brakes.Almost knocked me out of the truck.Very,very serious injuries to driver,no seatbelt,they had to lifeflight him out,highway was closed for hours.Thank god for plenty of witnesses.Did not have my flip down,but it is very stout back there,was like driving into an iron wall,cars engine was in his windshield.My stout ICC bar was in my airbags.
    His insurance company agreed to pay downtime,I had to provide them with all pay copies for the previous 6 months.They averaged out my daily pay,and paid me that,on the downtime.My trailer was in the shop for two weeks,could have repaired it myself,but it was 100% their fault,they fixed it.Turned out OK except for the young man in the Honda.
