I would wave this rule in his face and let him know he can retract your firing or you will proceed to contact the federal authorities. If he does not, then get an attorney.

You have to make him say he fired you because you told him you sick..If he says he fired you for just because, you have no case

Just move on and find another job.

I know it's awful but do you really want to go back to work there if you have to file suit?

They will either find another way to fire you or make your life he11 so you quit.

Normally a company is not going to fire a good driver not a fuel driver at that. It is hard to find good drivers especially hazmat drivers. I have refused loads out right & wasn't fired. I don't know your situation. If your supervisor is going to fire you just like that what does that say about your company. I wouldn't want to work for them if I'm a good driver they need me more than I need them

I worked a many times when sick. especially if I was counted on, or if something really depended on my being there. sick can have many meanings. runny nose, or really bad sick. I always had such good work ethic that if & when I was sick no one would question it, but that takes years to build that type of reputation. when I did work for a boss I may have took 1 sick day in 7-8 years. most of the time not feeling my best was not an excuse to me to call in, most not feeling well day's , after I went to work I felt better anyway.

hey as long as I can roll down the window or pull over & relieve some of my sickness, better than working in a 100 degree factory on a assembly line. I know I sound harsh, but.... oh well .. just one who was raised by the greatest generation. this question would of never been asked by my grandparents or any one they knew. good luck to you though.
