I need some help rolled a truck do to mechanical failure

    Your example is biased because it's your father.

    I and a lot of us will fight to the death to say and prove in our minds, that our parents can do no wrong.

    Woody's post was true and accurate as far as wooly knows. He doesn't know the op and makes his judgment based off the OP's op.

    Everything is just about speculation without none of us being there, but it sure does make for a fine debate.

    Exactly what I was thinking. I think your Dad was very fortunate to have a tow operator that spoke up. Most wouldn't say anything and would just want to get the job done. Not many companies are looking out for the driver in this situation.

    Improper pre-trip or driving an unfit vehicle is better than a careless driving I would say. Even if he wrote it up on his inspection report 6 months prior it would still be preventable because the company didn't fix it and he continued to drive the truck. "Preventable" can mean many things to many people.

    Yea i got the police report in hand you can look dead at it and see that was the cause of the accident

    So they can fire you for improper pre-trip if you didn't write the issue up but I imagine you can still get a job. If you reported the problem and they didn't fix it then I think you will be treated very well for a while.

    You might ask around to see if other driver's wrote that truck up. How old is the annual inspection? How long since the truck was in the company shop? Maybe the company mechanic is as much as fault as you for not catching the broken part. If they fired me for a mechanical failure I would lawyer up.

    Mac, U may have missed the Op's original post using the date of the rollover as August 31. After a couple of us commented he changed the date

    Ummmm using common sense about a FedEx wreck doesn't help your case one bit.

    Common sense says a kid will side with and protect their parents accidents. I mean unless you hate your father beyond the end of time.

    Honestly though, your going to tell me you aren't a little biased because your related to him? If he had an accident again, you would not take any side right off the bat until the investigation is complete?

    Are you a part time lawyer? I'm looking for one for anything in the future I may need a lawyer for.

    First, I'm glad you seem to know me so well!!! Secondly, I didn't take any sides regarding my father, if I knew it was his fault I would have openly said so!! I'm staying the facts that I personally know to be true and giving my insight into it. I don't care if it was Fedex, or if it was swift, a driver's life is important. I don't care for Fedex personally, but it was their equipment that failed, not my father or his driving skills, which undoubtedly helped his crash because while the truck was sideways he managed to avoid killing or hurting the people around him. That's not my account but witness accounts. So before you run off at the mouth super trucker know the facts!!
