    Brian, how does that work in a tow away accident?
    Seems difficult to legally define who is the customer when the driver/owner is not the one telling you what to do.
    Say you just pulled out an accident vehicle that looks like it came from Copart, you tow it to your yard, maybe you did more damage recovering it, the driver/ owner wasn't there at the recovery. How could the driver/owner make a damage claim when the when it happened is uncertain? Not to mention the claim would be moot if the insurance company says it's totaled.
    Also, say the cops on the scene tell you to move it NOW! and you know fast removal will cause more damage, who's on the 'hook' (sorry) for additional damages you as the tower may cause?
    I delivered a Copart car and the receiver claimed the hood had more dents than when I loaded it. Of course it did after the hood latch failed and it blew off the truck!

    As for secondary damage on accident recovery/towing, depends on the State if the tower is indemnified from liability or is fully liable. For example, Georgia has a quick clearance program, as does Illinois, where the tower can destroy your vehicle without fear of reprisal, as long as he was dispatched by law enforcement. This indemnification is something OOIDA is fighting against, they seem to think towers can take all the time they want to protect the vehicle and cargo, while still not charging for more than an hour or two of service, never mind the State Trooper yelling at you to get his expletive highway open and open now!!! (Sorry for the rant, they get under my skin) In my home state of Pennsylvania we are liable for secondary damage unless life is in danger, so we take a lot of photos and document as best we can.

    As for who is the "customer" in police initiate or otherwise non-consensual tows, the vehicle owner is still the customer so as a professional we the tower need to exercise a industry accepted standard of care, meaning we need to use the proper procedures and equipment and take all reasonable steps to protect the vehicle we are towing. Most law enforcement agencies make out some form of a tow request sheet which usually has a vehicle condition report and inventory listing.

    Side note, many police agencies will use the required inventory form as a reason to search the vehicle that is being impounded, and in most jurisdictions what is discovered will be admissible in court. I have had many impound tows for expired tags or no insurance and the officers used that to search for drugs, making a simple ticket a full on arrest.

    Some time ago truckers report was sued for allowing anonymous people bashing trucking companies on left and right.
    Plaintiff, a large trucking comp lost miserably.
    Keep on talking. At the same time take advantage of being anonymus. It's called a BENEFIT
