UPDATE: I guess Bohm Farms is out. Spoke with the owner again and I swear he wouldn't let me get a word in edge wise. He was reading my dmv report to me over the phone and either he doesn't know how to read it, or didn't care to hear my explanation. Either way, if he is like that, I don't need a job there.

However, had a sit down with the owner and Safety guy for Lake Seafood/Lake Trucking. Went very well. Owner basically said he wanted me due to my military experience and that I was a deputy sheriff. Said he wants someone with integrity. Discussed EVERYTHING with him and he didn't seem concerned. What threw me off (but understandable) is that he wanted assurance that the DUI was a one time thing. Promised him that it was. He didn't want anything to come back and bite him in the butt. So, took my urinalysis yesterday (quit doing meth just in time. LOL) and am awaiting word in approx. 2 days.

Be careful. You need a job in a bad way and your record is limiting your choices so ya gotta go with who ya can, just keep on your toes and be careful. Pay extra attention to those pay check stubs.

Update: IM IN!!!! GOT ME A JOB!!!! I think I'm going to go with a second company that I just had a sit down with this morning (CNA Transport out of Tampa. Ybor city location.) Reason I'm passing on Lake Trucking/Seafood is that I don't want to do a team truck. I already have sleep issues as it is and spending that much time with someone else is just setting myself up for failure. Second is, I need to get going NOW, not next week! I feel bad to keep bugging them, but time is of the essence here. The owner said he wanted to discuss something else on my psp and I was like "really, didn't I already tell my life story once." Said this in my head, not out loud. Anyhoo, checked in with them today and the owner was busy, the safety guy was busy and said "if you don't hear from me by 1300, give me a call." Well, it's now 1330, I've already interviewed with CNA, their insurance said yes and the owner wants me in a truck by Tuesday. Will have to do another whizz quiz, but that is of no importance to me.
Now, for those that can help me out,,,,,what are the benefits of a 1099 job? Can I write more stuff off? Will this make things easier for me when I go back to court for child support issues? Without going into to many details, I'm going in for a modification/lowering of support (shoulda done that when I left the sheriffs office, but didn't) and don't want to get raked over the coals.

I don't think that your problem is with the PSP score. It's your MVR.

With a 1099 job, you need to set aside 15.6% of each paycheck for social security tax. No ifs, ands or buts on that. So $156.00 of each $1000 is gone.

THEN you start worrying about deductions.

    Congratulations!

You need to talk with your attorney in regard to the modification and your circumstances. All any of us can do is tell you tales of our understanding of what we think happened to in a specific situation. Your lawyer knows the law in your state and the track record of the courts there.

As to 1099, you are being paid as though you are a business. So you have to take care of all the tax payments and withholding chores yourself.

This is not all that hard, but it requires diligence on your part or you will get in real trouble with your finances and the tax man.

That is why you'll hear so many people warn you away from 1099 work. A lot of people have been burned because they didn't understand what they were getting into, didn't get professional advice (and follow it) or figured it would just take care of itself. It won't.

Talk to the accountant that does your taxes, if you have one. If you have been using a service to do your taxes it's time to find an actual accountant that understands trucking. It is money well spent to get good advice on how to set up your accounting right from the start, what payments are due when and what receipts and records you need to keep. You can't deduct what you can't prove.

You can use GnuCash for accounting software, which is free, instead of buying something like Quickbooks. I use GnuCash for my personal finances and I used it to run a business for years. It is quite good.

    Good luck!

The reason people warn away from 1099 is because there is absolutely no way out can benefit you as an employee. It benefits a shady employer greatly to illegally classify an employee as a contractor.
1:they don't have to carry workmans comp on you. For a small company in trucking, in Florida that's easily 12 grand a year. If you get in an accident udent and get hurt? Tough cookies, you're on your own.
2: he no longer pays the employer share of social security, that's now on you.
3: no such thing as benefits. No group healthcare rates. For a shady employer this is great cause that's one less thing to deal with. For an employee wrongfully classified as a contractor, it means health insurance costs twice as much.

Now the op is in a bad spot so has to take what he can get, but for someone else with a choice, there is zero upside to a 1099 gig.
