Looking for a good lawyer to sue a trucking company.

    Plus any case I've read where the driver won it took over 10 years.
    I suggest disputing it with Hirerite.
    If that fails, contact state labor board for recommendations. It is, after all, they they are illegally trying to blackball you.

    Now that is of course if you are truthful in that it was a non-preventable on your part.

    This is where it gets confusing and tricky..
    Them saying the accident was preventable has noting to do with whether he was at fault for the accident, and it doesn't matter if the other driver was at fault and driving on a suspended license...

    I was working with a driver who was driving through Missouri, there was a truck on his left so he couldn't move over, there was a car coming down the on ramp trying to get ahead of him. He did not slow down and let the car go in front and the car hit his front right...

    He and the car pulled over, luckily no injuries, but significant damage to the car and damage to the truck as well, the police were called, the other driver was ticketed, and after two hours the driver was on his way again. Only now his 14 hour clock was low and he didn't have time to get to the receiver and had to stop for the night and deliver the next day, making the load late.

    After his load he was directed to the terminal to get his truck fixed, while there they wrote him up for a preventable accident, he got mad and argued with them then quit.

    Well, it was difficult for him to get on with another company, he finally did, but, making less than he was with the company he quit.

    From the company's view point, the driver could of prevented the accident by slowing up and letting the car get safely in front of him. The driver would of got to the receiver on time and out on another load instead of his truck in the shop getting fixed.

    Funny you mention that. JR Schugel did me that way as well. I reported an 'alleged' accident when a driver said I hit his truck. No due diligence done, no money in damages paid out, but I get dinged for 'telling on myself.' He said/she said, no law enforcement (happened on private property anyway) and I get dinged for just making a phone call?????? The deputy sheriff in me had a problem with it, but signed my paper and left the office pizzed off.

    It seems to me that we're better off not reporting any accidents to the safety dept. end up doing it the way the company wants you to and they turn around and screw you anyways! So why report it then?? Don't report it..... might get fired for it but who cares, i ended up getting fired anyways but at least they couldn't have put that accident on my record without doing a proper investigation 1st. The girl that hit me didn't want to involve the police and took full responsibility of the accident and said she wouldn't say nothing..... i could have gotten away with it. I had no damage on my truck but a little scratch on the front fender but that could have been from anything. Sometimes it's better off not to report anything!!

    Sad but true.

    We have that problem in a company of about 20 units.

    Things get dinged up, safety guy knows nothing about it. Something major shows up in a pre trip (stone chip in window, tail light out from backing into a dock, broken door hinges, scratches in the box, etc.) nobody knows nutin.

    I can imagine it's a million times worse in a major outfit.

    I am wondering I ASKED FOR TIME for FMLA they said of but it never happened... my mother died in the process and now im.having a hard time getting home for the funeral... Do I have a case here?
