§391.11 General qualifications of drivers.

(a) A person shall not drive a commercial motor vehicle unless he/she is qualified to drive a commercial motor vehicle. Except as provided in §391.63, a motor carrier shall not require or permit a person to drive a commercial motor vehicle unless that person is qualified to drive a commercial motor vehicle.

(b) Except as provided in subpart G of this part, a person is qualified to drive a motor vehicle if he/she—

(1) Is at least 21 years old;​

(2) Can read and speak the English language sufficiently to converse with the general public, to understand highway traffic signs and signals in the English language, to respond to official inquiries, and to make entries on reports and records;​

(3) Can, by reason of experience, training, or both, safely operate the type of commercial motor vehicle he/she drives;​

(4) Is physically qualified to drive a commercial motor vehicle in accordance with subpart E—Physical Qualifications and Examinations of this part;​

(5) Has a currently valid commercial motor vehicle operator's license issued only by one State or jurisdiction;​

(6) Has prepared and furnished the motor carrier that employs him/her with the list of violations or the certificate as required by §391.27;​

(7) Is not disqualified to drive a commercial motor vehicle under the rules in §391.15; and​

(8 ) Has successfully completed a driver's road test and has been issued a certificate of driver's road test in accordance with §391.31, or has presented an operator's license or a certificate of road test which the motor carrier that employs him/her has accepted as equivalent to a road test in accordance with §391.33.​

 

It's not even just about reading road signs and such but shippers/receivers get agitated when a driver can't speak English. I've seen it first hand.

There are trucking companies that will say that they would like for their drivers to be bi-lingual, although, they cannot legal require them to do so.

This tends to be true with trucking companies that do a lot of freight deliveries to and from the border towns of the southwest, (Arizona, New Mexico, and Texas), along with southern California along the border of Tijuana.

To a certain point, I can understand why.

The requirement for proficiency in the English language was not removed, only the out of service violation was removed. In 2015 the CVSA decided they would no longer place drivers out of service for not being able to converse with roadside enforcement. They still will note the violation and write a citation for violations.

I am not sure how all DMV Offices handle testing for CDL Tests, but I the Arleta DMV Office will fail you if you can't perform your pre-trip, air brakes, and road test in english. Watched it happen while I was there for mine a few months back, and there was guy when I waiting for my son that was there for a retest because he was failed for not using english. I didn't know California required you test in english only, usually I have to press 1 for english when dealing with any state agency.

 

Anybody thinking the Fmcsa is going to save them from non English speaking imagrants from taking their jobs is either naive or ignorant. Just ask a construction worker. It's laughable. The only saving grace we have enjoyed is they are by nature terrified of law enforcement.

I don't like it anymore than the next. But it is what it is, if anyone thinks laws will be upheld or inaccted to protect us...good luck with that. Only option is to pull the panties up and compete and do it better. Everyone in this industry is always looking to do it cheaper. The successful figure out how to do it the best....no matter what the language is.
