Can a drivers pay be withheld until the company gets paid for the load???

    Much as I expected; you want your drivers to be "responsible" for some of the downside, but not benefit from the upside.

    You are probably a company driver and never had to deal with your employees. So it will be very hard to explain to you something like what small trucking company owner has to deal with and has to go thru because of your luck of businessman experience.

    I haven't been an employee since the mid-eighties. I have started and owned numerous companies, some of which are now public as well as a carrier specializing in oilfield and heavy haul.

    You are not guaranteed to have a successful business. If you can't figure out how to fairly treat your "employees" then you should go out of business. Like every other industry.

    Treat and pay your employees well, or the only ones you will get will be crap.

    in most states the employer has to be able to prove it was intentional negligence to hold an employee liable for damages. but as you can see above, many try to get away with it.

    I do treat my drivers well. They get paid pretty well. Some of em work for me for a long time and they seem pretty happy. Also 2 of em grew from company driver to OO and still work for me. I hope it tells you something. Please do not tell me what I should do its not your business my friend. I just shared my opinion about what has happened. So cool down please.

    This ssdly is common practice in car haul.

    I have ZERO interest in 1099.

    That's not hard to do in car haul. We are required to inspect them before loading and note damage. They are then on us.

    Factoring companies usually charge the truck owner 3-4 percent of gross,to get paid immediately.
    The truck owner usually pays the driver directly,and weekly,because nobody will work,hoping to get paid on Friday.
    Obviously the truck owner is not concerned with keeping their drivers.
