In fairness, we have been letting carriers consume our time for free for so long that we have become accustomed to it. In other industries, people are expected to pay for their own training, before being hired, and that has worked out equally poorly for people who make a large investment in training themselves for those industries, for a less-than-expected return.
It's absolutely fair to expect compensation commensurate with the time and effort demands that an employer places on it's employees, whether before hiring or after. None of us are in this out of charity, after all. What form and level that compensation takes, is the point under dispute. The plaintiff is alleging that it fails even to meet the standard of minimum wage law in his state, and if that's the case, they are entitled to compensation to at least that standard, regardless of the direction that negotiations took, before or after they were hired. By hiring them, Swift agreed to operate within existing employment law...
We all have some experience with being lied to and taken advantage of, by carriers. Good on them, for standing up to one, over it! Win or lose... and let's face it, more probably the latter, no matter what the merits or circumstances of the case... :-/Phelps76, sgt50, driverdriver and 1 other person Thank this. -

Let's see, trainees are paid minimum wage while on duty. Minimum wage plus, while driving. Want to get paid for any non driving time, log it on duty.
Basically the plaintiff is admitting to falsifying logs, by failing to log work activities properly as on duty time. -
