I have a 1995 engine in a 2013 Peterbilt, is there any real guidance yet on when I will have to comply? Im assuming there is some ELD that will eventually work with my set up so Im not living in a dreamland where I will never have to comply.
Another question: I have what I call a "Frankencat" its a 1995 5EK block with a 2006 Acert right side (twins). It has the 1995 5EK stickers on the valve cover and oil cooler and metal plate attached to the block but Im concerned that a super cop will question the twins. Do I need some other documentation or do the engine stickers cover everything? Thanks.

I think you can get busted pretty bad if DOT finds out you have a 95 engine in 2013 truck, unless it came from factory as a glider

What is "busted pretty bad"? Please link to the law regarding that, thanks. I've never seen any DOT rule or law regarding that, the EPA has guidelines but usually only inspects glider companies not single truck owner/operators.

I was told that if your engine serial number is visible, that will be all the evidence that law enforcement should need. I talked to Detroit and they said I could get a letter from them with the engine serial number listing the engines age. This was before my company told me that all contractors would need an ELD regardless of engine or truck age.Oldironfan and Guntoter Thank this. -
They already have the systems to go onto the mechanical injection engines, they've been around for the past 15 years and it is all J1939 compliant.

Not my words. This is from a quick google search so it looks like you exempt:
Some believed that the model year 2000 refers to the chassis/VIN, while others believed it refers to the model year of the engine.
The FMCSA also never really clarified its stance on this exemption, until now.
As per a recent update by the FMCSA, it has been confirmed that the exemption applies to vehicles that have a pre-2000 engine model.
In other words, CMVs are exempt from the ELD mandate if they are equipped with engines bearing the model year of either 1999 or older. This status applies to vehicles regardless of its chassis model year located in the VIN (Vehicle Identification Number).Studebaker Hawk and Oldironfan Thank this. -
As far as the 95 engine in a 2013, the DOT has nothing to say about the emissions. That is CARB and a part of EPA. I do think that the only way a pre 2000 engine gets any lee way on the ELD rule is if it was installed in a factory glider.
As far as the Franken CAT again DOT has nothing to do with it. As long as 5EK is stamped on the block your good. As for the smog police they can only get you if is doesn't meet the original year model specs. Yeppers, like others have stated it's what is stamped on the engine is what really matters.

Yeah, I know Im exempt NOW, but my question is, how long do most of you think this will last? Everyone (including FMCSA) knows that there is technology around right now that allows ELD on my engine but I have no clue how long this exemption will last. Like most things involving government, its unclear. Im trying to (once again) put a 10 year business plan together but how do I do that when I have no idea what the law will require of me in two years. @wore out ... I do have all the new stickers from Cat showing a 1995 5EK but its far from stock. Im not too worried about CARB or EPA, my motor doesn't smoke at all, I have a weed burner thats sort of hidden (will be totally hidden in a few weeks) but Im hoping I don't find a CARB or EPA guy who knows there are no twin turbo 5EK's and ask why the actuator fitting on the back of the head is plugged off.

From what I am seeing where I am leased on the company will not lease anything on older than 2002. The pre 2002 trucks that are already their are heading to the house as the E-Log trucks are taking their 10 hour break. The grumbling from the guys sitting is getting management's attention
