I received a conditional job offer from a mega carrier under the condition that I met their prework requirements. I attended their orientation and was not able to meet their requirements, so they told me they could not offer me the job. Three months later they put on my DAC that they terminated me after 4 days of employment. The orientation is 5 days. I made it 3.5 days before I was sent home. How are they able to do this? I never made it through orientation and didn't deliver one load for them. Can I fight this in court?

first they said I was an employee...wrong
then they said I was an o/o...VERY WRONG.....
then it all got removed.
I too left after 3 days of a 5 day orientation.
contact DAC, via the forms on their web page, and rebuke that claim.
took me about 4 months to get those lies removed.

One question? Did you receive any type of compensation for the orientation??? If yes, you could be classed as an employee. If not, then , like you say, you never worked for them. File a complaint with DAC. The company has 30 days to refute your claim. If no they can't, then DAC must remove the statement from your record.
