You CAN Take CDL Training Outside Your Home State Without Relinquishing Home State License

Absolutely correct.

The school, actually, shouldn’t care. Where you are likely to get jammed up is when the state you test in, or your home state, refuses to comply with 383.79, and tells you to fly a kite.

Having recently been on the periphery of the process of getting one state to comply, it can be a years-long ordeal.

 

State of domicile “must” accept the results. Problem is that currently all states are not in compliance so in every instance it can’t be done for now.

 

You are correct, regarding the wording.

However, unless you get folks from the FMCSA involved, things don’t go smoothly.

Basically, there is some question (on the state’s end) as to whether it is ‘binding’ if the state hasn’t ‘chosen’ to adopt the federal regulation.

 

Most if not all states will fall in line. As a Third Party Examiner in my state we have been able to test out of staters for years but because of problems in other states my state decided to not allow us o do it. I suspect that will always be a part of it. Even if states are obliged to take results from another state, I've seen nothing requiring a state to test out of staters. In fact the reg states a state "may administer" tests to a person who trained in that state but is to be licensed in another state, and as noted above the domicile state "must" accept the results.

The situation here, was that the State absolutely refused to accept test results from out of state. They refused to accept that anything in the federal regulation applied to their jurisdiction in this matter.

Eventually, after a long time (years), it culminated in a meeting with the state, and some folks from FMCSA.

Thanks for all the information provided it was very useful for me. One thing confusing me a bit is that I passed permit test at MN DMV and got my (paper) temporary commercial permit and now I want to travel to MO to get my cdl skill test done. Do you think other states allow out of staters take their skill tests with paper CLP ?

A temporary CLP should be good for 45 days in any state.
