Cell phone and Seat belt violation

    I haven't gone to his links, but I googled it, and I found this in an article; "Speeding 40 mph over the limit, years ago, was called aggravated speeding. If the name of an offense gives a sense of how serious it is, consider that most crimes that are described as “aggravated” are felonies (eg, aggravated battery)."

    But he didn't say it is a felony. He wrote later "Speeding 40 miles an hour over the limit is a Class A misdemeanor. Other Class A misdemeanors include domestic battery, resisting arrest, and driving under the influence. Even though it is just a speeding ticket, it is treated the same as these crimes."

    No matter how he wants to qualify it, it is a misdemeanor in Illinois.

    Show me an actual state statue that lists speeding over 100mph as a felony without any other circumstances, not some attorney trying to generate business.

    I have worked in several states and never seen a statue backing that as a felony, misdemeanor sure.

    Also most states do classify most traffic offenses as infractions. One major reason is you are not entitled to a jury trial for an infraction. Saves the government a lot of money not seating a jury.

    Trucking companies view it with more scrutiny and more seriously than taking a hostage during a bank robbery.

    Yes street racing will land you in a deep pile every time, but they have to catch you in the act simply saying they know it was you by the exhaust note wont hold up in court i don't believe. Unfortunately we don't have the officers who would let you get away with that sort of stuff anymore, heck jist simply spinning the tires a little bit will get you careless driving and you don't even have to hit the speed limit.

    That was my thought as well. That jury thing can be confusing. Some places it goes by the amount of the fine if you can have a jury. In Georgia you have the right to a jury even if charged with stealing a piece of bubble gum. I used this in Habersham County Georgia State court acting pro se and beat 2 bull crap charges in a jury trial. If you doubt me go ask now State Court judge then State court solicitor Steven Campbell about the guy that waxed his butt over a tag light out and a failure to maintain lane ticket. Happened in 2009. If you do, tell him the guy from Toccoa said hello and he is still a twerp!

    All of you have been very classy today with your responses.

    I suppose in the end of day after all of this, Im forced to take back the word Felony attached to speeding.

    Maybe I made a mistake somewhere over the years and can use a education or correction. Im truly sorry to those who think I wasted some of their time being stubborn defending or advocating or possibly going down swinging over something I might wrongly believed in.

    With that said, I'll just wave a white flag meekly and hope that all of you don't think Ive gone stupid brain dead and cannot take learning or teaching. If anything that is a flaw with me, is that people say it aint so or call BS on a position I might take with any subject at the table, whatever it might be.

    Maybe tomorrow is a better day. Again thank you all for putting up with me.

    It can. After my ticket was dismissed, the clerk warned me it could go on my criminal background. I had to file separately for an expungement.

    A felony can be assessed against you if while racing, driving drunk or speeding you badly hurt or kill while doing so. This was what that attorney was trying to get across in that website. Racing, DUI/DWI and excessive speed are considered major offenses in most every state. In most states you are arrested and in some you can't make bail until you go in front of a judge and have bail set. You also put your drivers license in danger and might well lose your CDL. Not felonies but so dang close that you don't want to get caught doing any of them.
