7 Points for not switching to SB after Off Duty

    I move my truck 10 times a night at the dairy " off duty personal conveyance" with a note put in as Parking move

    I asked our safety twice if this Kosher. They claim we are Fine. Don't worry. Parking moves are legal.

    I never enter SB when I am in the bunk in the truck. Simply off duty .

    Heck the other night I drove around for 4 hours off duty personal conveyance and ate up 4 hours of my off duty time.

    Safety says technically I could drive around 10 personal conveyance and meet my 10 hours off requirement.

    If those moves are in fact personal moves (as in you'd make the same moves in your personal car if you had it), then that's fine. If you're moving the truck to reposition it for work, that is a different story and you're falsifying by claiming the moves as PC. Doesn't matter if it's ELD or paper, the rules in that regard have not changed...only now, the ELD tracks that movement, where paper did not...making it more likely you'll eventually get caught. Hell, you could have the ELD on PC all day every day and the stupid box wouldn't know the difference...but just because the box allows it doesn't mean it's legitimate. You're still falsifying, and still deserve to get that citation when caught.

    In safety I advise my guys to only mark what they are actually doing. If you are in sleeper berth then that is what mode you should put your ELD in and if you are driving the CMV for personal reasons (legitimately) then use that mode. We actually have our dispatcher leaving this Friday and I will be taking over that roll in the company. I let the drivers know that I still am going to ask the same things of them. Be safe and log it exactly how it happened.

    If a dot man is trying to charge a driver with something the burden of proof
    is on them .

    I learned that running in Az years ago ... running the I-10 was like a gauntlet in some areas
    ... dot sat on the side of the road and picked off truck after truck like it was a game.

    A supervisor where i work said if they challenge you on anything advise them to depose you in court do not talk to them or say anything beyond that .

    My understanding is unless you drive team, off duty and sleeper berth are the same thing. You can’t be in the passenger seat (off duty) while your partner drives for more than an hour I think. I really find it hard to believe this ticket was issued, and I’m convinced it would get thrown out in court.

    Some folks, perhaps out of boredom or lack of other interests, are fascinated by this regulatory staff. The next thing were are going to hear will be some "illegality" of holding the steering wheel in any other way but "10 and 14" positions or total prohibition of adjusting the radio knobs while driving. I do 2-8 split a lot (now when ELDS are in place) and while on 8, I am rarely in the sleeper for that long - continuously, as I typically need less then 7 hours of continuous sleep at this point of my biological life. Especially, when (due to current HOS that cannot be overridden by "common sense" due to ELDS) performing the 8 hours during daytime/daylight. I must be a big time criminal because I am breaking the law and doing so conscientiously for that matter. Should I feel bad and turn myself in?

    Helll I am not old!!!! I am still in my prime - advanced 40s. For the last 5 years or so I noticed I don't need to sleep in any more. 5-6 hours of sleep is what I need, then I wake up without any alarms.
