Violations like those are 100% avoidable. I know my company certainly isn’t in the business of getting ELD violation tickets,Especially the ones involving not have any instructions for the ELD. There’s also violations on file for defective equipment with this organization. Oil or grease leaks, not having reflective DOT tape where required,ABS light not operating, are all of those count as vehicle defects and again, violations for those carry weight.

Having said that,I’d give the OP the benefit of a doubt as his/her experience may be different from other drivers.

Yeah better than national average (20.5%) but I would not look at a lowball company like this. Way to many easy fixes that scream a dispatch more interested in hauling loads than maintaining equipment.

You know I started to to get drawn in just for argument sake. But I'm not gonna play. Think what you want. I know for a fact that this company does NOT run unsafe equipment and they take care of their drivers. There is a big difference between unsafe equipment and an abs light not working or a piece of dot tape missing.

 

Not as far as DOT is concerned. When it’s all said and done those little issues can add up to bigger problems(and fines to match). Their method of thinking is if the driver is driving with said ABS light not working(which can result in an OOS order BTW) or missing DOT tape(which is covered under conspicuity regulations in the CFRs)-what else could that driver be hiding or overlooking? And the Feds just recently increased fines for a bunch of issues.

But you don’t have to take my word for it.
Look at every violation listed under your company’s name. That should tell you how serious DOT is on the matter. It’s listed in that federal database for a reason.

 

Neither of those is OOS. If you are happy great.

Does not change the view of the OP, or my opinion that a 10% equipment OOS rate shows bad drivers, bad maintenance, and bad management.

Order those three however you wish.

 

Since when is a malfunctioning abs light OOS?

 

I said it could,I didn’t say it was definite.
Usually it’s up to officer’s discretion,unless they find other defects. Sometimes I also can depend on the company’s reputation. I can tell you firsthand that Western Express had a history of ABS light issues on their old trailers. ABS light on, ABS light unplugged,etc. Naturally, DOT would go over them with a fine toothed comb if they got pulled into a scale house.

 

Fine tooth comb I would agree with. And yeah it is a ticket depending on inspectors mood.

However OOS criteria is laid out and I have never seen malfunctioning ABS light listed.
