    True, government shouldn't be forcing people to allow truckers to stay on their private property but then they shouldn't punish a trucker for having to move when their clock has been burned by said owner of private property. Perhaps the government could design rules to avoid this situation, but they won't because the government is stupid. And I know that good planning can avoid this is most situations but a trucker shouldn't be punished and fined when he shows up with a full duty clock and that whole clock is burned by a shipper or receiver. What's the driver supposed to do? Who fights for the driver?

    There's no amount of planning at some of these places. We have personal conveyance to move to somewhere to get away from them. That's what has to be done. At least until split break rules are changed as promised.

    I've heard that personal conveyence doesn't always pass muster with DOT...because why would the government be helpful. Oh well.

    I've heard all kinds of things. Define DOT. The guidance allows the move, for personal use.

    IndianaJack (trucking youtuber turned Safety at his company) has just lost a dataq for one of his drivers who was popped for using P/C after getting empty in Huntington Park CA and moving to the T/A in Ontario after his hours expired. So there are still some DOT out there who will write you up for using it and deny that they are wrong about the new clarification of the rules.

    Here is the video and time stamp of the conversation with Oregon troopers where he lost the argument for his driver using P/C--

    Yeah, that's exactly where I heard that story. As was stated above, it is a GUIDANCE, not the RULE, so for some reason DOT or State Patrol or whoever is doing enforcement and checking the log can choose to go with your story of personal conveyance or not.

    Guidance is the term the fmcsa uses to tell officers how to do their job. In practice this makes a guidance a rule.
