It’s actually not illegal in Mississippi. Following too closely is, but that’s up to the officer writing the ticket. Any combination vehicle has to stay at least 300 feet behind another combination vehicle unless overtaking.

The insurance company can claim they slammed on brakes causing the accident, but rear ending someone always places blame on the following vehicle. The person can say a deer/possum/rabbit etc was running across and they hit brakes to keep from running it over. The accident won’t occur if the trailing vehicle is following at a safe legal distance.

 

No it does not. A vehicle that slams on their brakes to intimidate the following driver is participating in road rage and is at fault. I've already posted that information on this website from a personal injury attorney's website. Most states say that slamming on your brakes to miss an animal is not a good enough reason to do it. If they say its a moose ok but you have to prove there was a moose. Saying they did it to avoid a rabbit.....nope. Because for a rabbit you can cause a mutlicar pileup. The road is not your personal driveway you must drive in a manner that does not intentionally put others in danger.

They can't just "claim" something. Especially if the video from the truck clearly shows there was no reason for them to slam on their brakes. As I'd said before, brake checking is illegal in all 50 states and is considered a form of road rage. Hitting someone from behind in a brake check situation is on the brake checker.

You will not find a single brake check or road rage law on Mississippi’s code of 1972 motor vehicle chapter 63 that includes all moving violations. I have a copy here, have written up to 30 citations a day, and am married to a state Supreme Court staff attorney. I know what I am talking about, that link you posted is for Arizona.

 

Slamming on your brakes to intentionally cause a motor vehicle accident is illegal in all 50 states.

An attorney in Arizona, unless licensed in All 50 states, has no idea what laws exist in them. My wife works on all cases, both criminal and civil at the highest court in this state. She has Lexis Nexis access and every case in state history at her fingertips. There isn’t a criminal law in this state for brake checking someone. There isn’t a road rage law either.

Now, civilly they could be deemed partially responsible for damages, but not criminally. The person following too closely would get the citation.

Um yes, I was driving a commercial straight tanker since 2002. There are other vehicles to drive commercially for besides Class A. Dont pretend to know what the #### I do.
