    OMG, this gets more and more confusing.


    THERE IS NO LAW OR REGULATION.

    The FMCSA did us no favors by writing a guideline to something that was always a state/carrier defined issue. NO where in the regulations I searched was it mentioned. IF it is, please show me.

    PC is to be used to go get something to eat, get groceries or get a place to sleep - with some other added things in there like movies.

    PC as stated in the guidance is NOT to be used to home - this is part of the starting and stopping location for work.

    The guy who matters is the guy who is doing your inspection, he will interpret it as he likes.

    It does not matter what anybody thinks or what your safety thinks, What matters is that what a given cop confronting you thinks and makes of your PC at a given time.
    A dude got a ticket and 10 hours OOS in Indiana as he drove to his terminal in IL from Toledo, OH with empty trailer. He thought, he was told to come back to the terminal but he could always say he was going home, also he was over 14 hour and he thought PC is like driving a Personal Vehicle, so as soon as he does PC he is exempt from HOS. The cop just told him PC is all right for up to an hour or so and for small local runs. Going over 200 miles, after his ELD shift clock of 14 hours was over long time ago, was not acceptable.

    You can always get a ticket if using PC,while otherwise you'd be driving against HOS. Then you or your Safety Lady can go to court and argue you were correct with PC and not the cop.

    If you want to take the cynical view this can be applied across the board on every subject. Cops are allowed to exercise judgment in regard to what is a violation of most anything. I am also sad to report I agree with you. I find it pathetic that the FMCSA was forced to get involved in this. The FMCSA was forced to change their guidance on this after changing the HOS rules bringing in the 14 hour clock. I really wish the FMCSA had left the PC rules alone and made an exception to the 14 hour clock to allow for a driver to get to a legal place to park.

    However, any company is also permitted to restrict the usage of PC.

    yeah about that, if you are offsite, it implies you are to start and stop your work day there. Most people don't start their workday at an offsite location, but rather either at a terminal or at home and PC doesn't apply in either of those places.

    Which is why I highlighted the whole thing. There is also a section that defines the offsite location.

    In the end, it all really depends on the DOT officer that you get anyway and their interpretation of everything.

    I just added it in because I was bored.

    It also depends on the company, I have leases with a few and between all of them, PC is allowed with one and it is spelled out what the driver can and can't do, the others say ... NO.

    My insurance people told me they hate it, it is a liability because of the logging issue and the abuse that goes on, some people are traveling 400 miles on PC, a few here admitted to it and that's a big NO.
