Now that Im thinking about it, I dont know of any law requiring a driver to use the runaway ramp. Just seems like common sense to use it but probably not a law. My guess it will be speeding/reckless driving that resulted in multiple deaths.

If they can get evidence from the wreckage to support the charge, I say vehicular manslaughter for an improper pre trip. Near as I can tell the only thing the driver was actually required to do by law was a pre trip. Not required to take the ramp. Not required to roll the truck or rear end another truck.

Also going to charge the company with something reckless or negligent for poor maintenance or lack of training for that situation

I’m hoping it was an auto trans failure.....oooohhh pleeeese be an auto trans failure

Not sure that helps his case. It would still mean he was coming down too fast, and really #### him for not taking the runaway ramp.

As for the fluid, one has to wonder if he put a rod through the pan. It'd be easy enough for a panicked driver to stay in a lower gear and overspeed the engine.

Without seeing the scene, I can't say.

However, once you close your eyes, you have no chance to even try to guide your vehicle and attempt to hit other vehicles at angles that might allow more survivors.

In the end, at least for now, we really don't know enough to be too specific in our criticisms, but I think that no matter what actually happened, we can all agree that the fellow ####ed up somewhere along the line. Even if there were critical equipment failures, he could almost certainly have done better, and saved lives.

It’d suck to be one of the four but that was a low death count.
How many people got seriously injured?

As we suspected, it's very possibly the first time this guy went down a mountain. He was hired less than two weeks before the crash and took the job so he could get away from being an intrastate TX driver. Also the worst kind of truck driver.....the type with no pride in the job....... didn't like driving a truck, only doing it for the money.

Truck driver blamed for I-70 crash just recently started new job

Diaz says Rogel was thrilled when he was hired by Castellanos 03 Trucking just two weeks ago. She says the new job allowed him to drive truck outside of Texas.

"He was so happy because when you go out of state it's more money. He's so happy," she said.

However, Diaz says Rogel was only a trucker out of necessity. She says it was a means to pay the bill sand support this 4 year-old son back in Cuba.

"He doesn't like it. He always says this isn't for me. He only does it because he needs the money," she said.

    <snip>

Friends say the truck Aguilera-Mederos was driving was new. They also say he did not have any difficulty reading English.

Authorities say Aguilera-Mederos was living in the United States legally after moving here from Cuba about four years ago.

Everybody says that, only the truly lazy mean it. I had no job for 6 months once, nothing to do all day at all, the longest and worst 6 months of my life, including the 6 months not able to walk without pain after my car accident.
