I’ll make a long story short.

Finally get in with small mom and pop mid to small size company. About 230 truck, everyone knows everyone.

Go out with trainer. Week one is good. I burn up 3580 miles while trailer sits up front the entire time. I sleep on non moving truck. Life is good. Trainer a bit abrasive and barks out orders when I’m going to do them a second later or already have, but ok, nobody’s perfect.

Get into second week. Company switches to new ELD and guess who they’re experimenting on? Yep, me. Trying every way possible they can think of to mask movement etc. doesn’t work, the system warns, red flags and evrualoy shuts me out. Trainer handling my logs entirely.

If that’s not bad enough, we are driving along I tell my trainer I got 40 minutes left on my 14 hour. I ask how much longer until we stop (he doesn’t use GPS) he looks at me and says “oh it’s another 80-85 miles, we ain’t gonna make it. We are stuck in traffic too. You’ll just have to take a violation hit, it is what it is.” I respond, “well can’t we pull off and find a warehouse district, (I point to some) he laughs, “no we have to get to the truck stop” I point to some other trucks pulled off curtains drawn at apullout, “look, we are going to stop where we planned, I do no sleeping on the side of the road etc, we will just report it as stuck in traffic looking for a safe haven.” Then I ask why don’t you drive? “Oh I’ve on duty as long as you have I have no time left either” I’m thinking well this is all on you, youbget over here and drive and take the hit. I end up going over 56 minutes.

Here’s the thing. This guy is family to this company. Isn’t gonna be no going over his head. They’d tell me to park my #### and hit the road. I’m tired of this #### ####. I went into trucking with noble hard ethical intentions. I had urges to stop the truck when it showed 3 minutes and just refuse to drive but I’d be back to square one looking for a third company.

I guess maybe I should just get a mean nasty attorney and start suing all these filthy shady companies and retire! They deserve it. I’m
    Pissed!

So what does this do to my record? Remember I’m brand new too.

The wonderful world of trucking has always been this way and I seriously doubt it will change anytime soon.

you finally "get in" with a small company......????

what are you going to sue anyone for?

i love how people turn all legal on the internet, when something goes in a different direction, than what they expected.

no, i am not kidding...put in 48 years like me, and tell me it's all peaches and cream.

    lawsuit happy people,,,sheesh.

sure a lawyer WILL TAKE your money, but will you win..?? would you have the time to leave a job to go to court, each time there is a delay or motion to move it to another date?

just get another job, and i guarantee you this...you WILL find something worng at the next employer, and the next, and the next........and so on and so forth.

No attorneys. Part of the game. Soon enough your resume will dictate that no trainers are needed. I don't condone by any means your douche trainer but it's up to you to get to a point where they aren't needed. Suck it up. You where stuck in traffic and his fat ### wanted something to eat.

First I don’t want to sue anyone. I want to drive a truck. I expect a company to do their part and I do mine, I now have two marks on my record and a direct result of total disregard and negligence by a company. I am a new driver. I drive #### good too. I may be railroaded right out of an industry I spent a year preparing for because companies operate illegally or do what’s right.

Your darn skippy that’s a lawsuit! Do I want to sue? Hell no! I want to be given a fair chance!

Fair enough response. But what’s the outcome from this violation? How serious is it?

The "safe haven" thing is legitimate, you just can't go to your planned stop, you have to find the "next safe location" (if that's the dirty truck stop 40 miles up the road instead of the one 80 miles, then so be it).

A violation with remarks justifying the violation (within the confines of the exception) won't lead to a ticket if you explain it to the DOT officer and they are being reasonable. The company won't hold it against you if you document everything.

Trucking is a shady industry, you're going to have to accept that if you want to go anywhere in it, but you have to remember, the "rules" in trucking are meant to be bent as far as humanly possible in order to get the job done. That's just the industry's expectation, no beating around the bush here. It's just a matter of not breaking them entirely. You'll learn as you go how much you can bend them.

You're on your second week (I assume in trucking in general?), your expectations are high and you are still greener than spring grass. The sooner you lower your expectations and "roll with the punches", the more you'll start to enjoy it.
