Yes it's Constitutional. The basis is driving is a privilege not a right. And only rights are protected by the Constitution.

You have that backwards....A judge sentenced him to 30 years in prison with all but 25 suspended.

Its a way to shorten sentence but still hang that time over there head when they get released on parole.

Moving Forward, COBB2070 and D.Tibbitt Thank this.

Supreme court ruled it's ok for Police to draw blood from unconscious person who is not able to give consent and is a suspect in drunken and or drugged driving.

I am one of those who follow the Constitution with a small book of same under this keyboard. But the way things have gotten these last 15 years or so quietly bypassed by many levels of local governments on up that implies since you are using a public road you have implied consent and cannot refuse. (Sure you can, but it will destroy you and they will have what they want anyway.)

If you own a ranch the size of Rhode Island somewhere out west and don't need the Country for anything, then yes you can stand on your own resources. It's a example of what's possible. But no one gets to be sovereign in a world increasingly intent on possibly capturing and prosecuting those with pre crime or even thought crimes.

He'll be 80 when he gets out. If he does anything, even a misdemeanor, he'll go back for the suspended 5 years. He'll be on probation until he dies.

D.Tibbitt and Moving Forward Thank this.

That sounds fair to me, but it seems some folks don't exactly agree with that.

I agree he should have already been in jail, but two of the previous courts didn't exactly let him slide. One revoked his license. One suspended it.

That's odd by the way. He must have been on trial for both offenses at the same time, otherwise the La judge couldn't have suspended a license that had already been revoked by the Va judge.
