Have to show on-duty not driving while mowing the lawn?

    Please correct me if I’m wrong.

    It was my understanding that if I get out of my truck and go to another paying job, let’s say as a male dancer at chippendales I would be required to log that as on duty since I’m not officially getting my 10 hour rest break.

    In your case it's off-duty because it isn't for a motor carrier and their ain't no way anyone is paying you to take your clothes off... keeping them on, maybe.

    Yes u are grtting ur 10 hour rest break because u are off duty from ur trucking job and getting tips put into ur male thong, which has no relation to ur truck or load or duty as a truck driver

    Then again even if they do there is no way to prove you did or didnt do it unless you gotta neighbor that really hates you

    I've always been told from multiple companies to include a remark if it is anything other than SB or off-duty. Never bothered to check up on it just took their word for it. It's not like they asked me to donate my left testie so lol. Also doesnt affect yer HOS so. Ive always been...not serious with them tho. Usually said EXACTLY what I was doing so anyone looking at it would be like...tmi.

    Yes, it would be on-duty. From Part 395.2
    On-duty time means all time from the time a driver begins to work or is required to be in readiness to work until the time the driver is relieved from work and all responsibility for performing work. On-duty time shall include:
    (8) Performing any other work in the capacity, employ, or service of, a motor carrier; and
    (9) Performing any compensated work for a person who is not a motor carrier.

    That falls under 9, any compensated work for a motor carrier
    As for the op, it's not getting paid, and it's not for a motor carrier so Off Duty. If he was doing a lawn business 'on the side' it would be on duty...

    That's what I thought. But it's BS imo. What's the diff between mowing a lawn for cash and mowing a lawn for free that requires the former to be logged on duty? Like, is landscaping for cash harder than doing it for free? Just saying providing the HOS rules supposedly exist to make sure a driver is well rested.

    On the other hand. A DOT that pulls you over cannot prove that you do work on the side unless they know you or you make it obvious, like putting yer side biz decal in yer vehicle you use as a CMV and being covered with grass stains and ####.

    It isn't the DOT that would be an issue. Your problem would be the attorney for the family of the drunk who crossed the center line and did a 65mph head butt. That attorney, working in the best interest of his client, would most likely discover your for-hire side business and, upon checking your logs, discover had you logged it correctly, you would not have had enough hours to be where you were at the moment of the crash. That results in a large payout for him, a lesser payout for his client, and possible jail time for you.

    The difference tends to be mowing one yard is fine. Takes however long, but say an hour. Mowing 30 lawns would take 30 hours and that leaves you only 4 to rest on the reset...
    Basically once money is involved most people will treat it like a job and try and make as much as they can.

    As for finding out, sure on the roadside no one will ever know. It's when wrecks happen and lawyers get involved it becomes an issue.
