Before my mom's husband bought his own truck, he was driving for someone who had a fedex contract doing drop and hooks from central IL to Chicago. He came down with a bad cold and was off for about 10 days. One night he was coughing and couldn't sleep so my mom made him get up and take some of her cough medicine, which had codeine in it. He got called for a random either the next day or the day after. Obviously tested hot and they asked him to come in for a retest. He admits to the codeine and doesn't have a prescription for it. They treated it just like it was illegal drugs. He lost the job and lost his cdl for 3mo I think and had to do 6mo of drug classes and I believe had to pay a big fine.
Being this was going to be his "retirement job" it was either buy his own truck and get his own authority or just forget about trucking.
Get that charge reduced, pay whatever fines and be happy your boss kept you employed. Getting your own truck & authority won't be affected except maybe insurance.
Smoking weed in this industry is stupid. It'll cost you your job when no one else really cares.
I know im a #######. But is there any hope to come back from this?

It will show up on a criminal record search. Might have trouble with military installations, prisons, ports, Dept of Energy / nuke sites. The way they are legislating everything into Jail, you would imagine they might make Coffee illegal and a criminal offense to boot. /snarky.

DOT drug tests require laboratory testing (49 CFR Part 40 Subpart F) for the following five classes of drugs:
- Marijuana.
- Cocaine.
- Opiates – opium and codeine derivatives.
- Amphetamines and methamphetamines.
- Phencyclidine – PCP.
It is what it is. -
First question, how did they find anything.
Was it out in the open? If not, and they had to do a search, did you give permission?
Check the citations you were given, it should have the violations listed, this will also dictate what court it goes to.
Would think that this is not a moving violation, and not against the DL. Surprised they did not call for a test van.
The problem here is that it is on an inspection report for a CMV. This will end up on your PSP report. The question is can a dataQ be done and have that taken of the inspection and deleted from the PSP.
Now, what ever comes from this, you deserve.
You made a decision, a bad one, having a controlled substance and paraphernalia, and you should accept the consequences of your decision.
It seems you are aware of the fact that controlled substances, like marijuana are banned from use by a CDL holder.

In the CMV world, there is a big difference in getting caught with drugs and having drugs in your system. As far as CMVs go, the consequences are much worse for drugs in your system than it is for transporting small amounts.
Now I’d say you probably had some in your system also, but the question is did they test you and you failed?
