Most of the time that crap is not worth the paper it's written on and is not enforceable. People have a right to work, period.

It is an unenforceable clause because you are not taking anything from the company with you like sale info customers lists or anything that can damage the company.
On top of that, you are not a skills trade, you do not belong to a profession that can take business away from that company, because you are regulated general labor.
The company can't force anyone not to work for any reason, but a lot of people are fooled and threatened by this idea that putting that clause into a contract it is enforced and your career is done with.
This is another thing that the Feds can fix, by not allowing it in employment contracts. -

i wonder that IF a company in trucking or a school really tried to enforce that clause, could be counter-sued for denying gainful employment..?????

Who paid for the school? Did you pay out of pocket, or was the company that you went with suppose to reimburse the school.
I am just trying to wrapmy head around, how they can call it a noncompete agreement.
My cousin worked for a brokerage in New Mexico, he signed a noncompete agreement that stated he could not work for another brokerage 100 miles or less away. He quit after a couple of years and bought a place in Texas, 120 miles away and opened his own brokerage, they took him to court and he lost, he was court ordered to not work in any capacity in the transportation industry for 5 years. -
HBO, or Showtime, or some other movie channel is calling me.. -
So I get this email from another member a while back, won't post it or who but he claimed that there have been court cases that forced the employee to find other work somewhere else so I asked my legal advisor and he came back with two cases that stick out, both of them have to do with pilfering employees, nothing else. I don't have the cases but they have been discussed here before.
