I received a 14 hour violation, but there’s only one problem.........

    Nothing wrong with the log. At least for that very day. I use KT too and it is very accurate in catching HOS violations.
    Before hiring a lawyer,
    I would call the DOT cop's captain or a superior explain that their officer was incompetent *delicately* and offered to re submit the logs and subsequently request the correction.

    I have to agree.

    Nothing really jumps out at me just so. I cannot point to AHA! THERE YOU ARE!!! BUSTED. there is none of that here in the docs presented here.

    DOT is not all bad people, but once in a while you find yourself with a rattler and a problem.

    Regardless of the outcome of correcting 14 hours, it is more important to fight the moving violation. It could be coded as traffic control device violation which for instance in IL is a "serious moving violation" on par with " follow too close" or speeding over 15 etc. Two of them in 24 month period and the licence gets revoked. Of course, insurance and safety score are compromised too.

    LOL. You beat me 2 it. My question was going to be has anyone ever had a violation reversed through DataQ? I've yet to find someone that successful has....

    Sometimes I grow resentful with the States evolving the CDL as a instrument of punishment. Two strikes or three strikes yer out. As in all the way out. As a weaponized economic club on your head written into the law by people who have never touched a big rig ever.

    Many years ago before all of that stuff in the States (Downgrading for not Medical card valid etc) we were respected as professionals. Now we are treated as a flip flop wearing flopsie to be kicked around and to the curb by the State at a moment's notice for anything.

    Sometimes Im tempted to go down to our CDL division in the State Capital and make faces in the windows they never spray clean. ... //snarky.

    I did not have it done by Data q or whatever it is but by an inspector's supervisor at a CA weigh station. I refused to sign the Inspection report and requested to see the supervisor who himself reexamined the truck.

    Actually you were, because you took you 8 off , that's fine but the next off duty or sleeper berth has to be 2 hours and it is not, At 8:30 you went on duty, then 8:40 you went off duty and this would start your second off duty period for the split, Then at 8:46 you went to the drive line ending then second off duty period of the split. So at 9:27 when you go back into the sleeper you take a 2 hour ( the logbook would count this as a new cycle) your going to need a full 10 hours to clean it up.
    You won't lik this post but this is exactly why a lot of companies won't let drivers take splits sleepers.

    You have to have a 8 with a 2, not a 8 with a 6. the 6 DQ's you from being counted as a legal split. Now you may get a judge that does not understand Logbooks, or maybe the cop wont show. But you did not do a legal split break.

    Lane violations, if your in a lane that your not leagally allowed to be in that is pretty simple, But I mainly drive in the states of trucks stay out of anything but the 2 right lanes, So I don't know, If it is illegal the state is not required to post it, you might first check on the states web site to see if its noted there. Good luck contact a local traffic lawyer.

    I have. Running a flatbed with three markers lights in the rear center of the trailer running from WA to TX. They were fine untill I hit TX bumpy roads and two of the marker lights came unplugged. I noticed them at a fuel stop and just plugged them back in, must be a fluke.... A few hours later I get pulled over and yadda yadda, the guy wants to give me an inspection. Ok, no problem. The two maker lights plugs worked loose again and I received a failed inspection.

    One marker light was still operational so I still had required lighting. It took some time, but dataq sorted it out.
