O/O leased on and I damaged my trailer, Carrier refuses to file a claim.

    I was recently leased on to a carrier. They required that I have bob tail insurance but the trailer was insured by them as non trailer interchange because I was hauling their load. I clipped my trailer on a concrete block because a man pulled up next to me with his trailer on fire and I tried to get out of the way quickly. They have a $1000 deductible, they lied and said it was $5000 at first until I looked at the COI. They deducted my last pay by $150 with no explanation and removed me from loads with them. Now I am out of a trailer and they are refusing to file a claim. They feel I am lying about the damage and I planned this whole thing but thats ridiculous. I have a crash report and even though the trailer was damaged I moved the refrigerated product to another trailer to protect them. This is how they repay me. What do you guys recommend?

    I do not know what to tell you, do you have or can you get a baseball bat?

    I can't imagine not having insurance on my own trailer though.

    You can call their insurance and file a claim yourself. You don’t need them. You have a contract and your vin should be or have been on the policy.

    The way I understand it, anyone can file a claim, now if it is just some idiot off the street trying ti file a bogus claim, the insurance company may not open one unless a lawyer makes them.

    I am out of a trailer becuase of the damage to my cross members and my back rear axle is bent. They were using my trailer.

    I'm not a insurance guy but unless the burning trailer damaged your trailer I dont think it would be considered relevant in anything other than the explanation of why you hit the poll.

    Not trying to say you shouldn't get a insurance claim but if I understand your story correctly you drove forward and hit the poll and that's what bent the crossmember and did whatever to the axles?

    I know the other trailer fire is why you moved but I think so far as a insurance claim goes it's kinda irrelevant unless the fire did actual damage.

    Sort of like if you drove off the road because you saw a wreck on the other side of the highway..

    So far as the insurance claim.. I would contact the dot or the insurance company and ask directly how to move forward..

    If you were using the trailer under their authority then you have a right to file a claim.. They cant tell you that you cant. It's not the company's decision to decide if you are filing a false claim or not, it's the insurance companies.

    As far as trailer being ruined.. They can fix cross members.. At my old company we had a full fledge trailer shop and they'd completely rebuild trailers.. So long as the trailer is worth the repairs it can probably be repaired.
