My Questions About the New Clearinghouse Database

    I'm a white hat. I know how easily it is to hack things to get personal information. And we are talking about what I would consider medical records.

    Wow, you guys ... don't you know everything about you is already in databases and the information is so easy to get?

    It amazes me when people don't get this, hell now you can put in your license plate on one auto classified site and get back an accurate value of your car - you should all be paranoid about these consumer/personal data sites more than any FMCSA related site.

    The ones that I saw go out of business built a pile of paper. That computer stuff was then disposable.

    Today I worry that if you work somewhere, there is a database big enough to contain that when the company itself vaporizes.

    There is no driver shortage. There never was. If there was a real driver shortage, the walmart shelves would be bare because of lack of drivers. The warehouses would be empty because there wouldn't be enough drivers. You couldn't fuel up your car or truck because the fuel tanks at the gas stations would be empty from there not being enough drivers.

    No true, I can hire anyone I want, NOT all drivers need a physical to work.

    This database is CDL drivers who failed/refused drug screening;..

    Page 3 pf the FMCSA FAQ says 'regulations require employers to both query and report information"...

    Page 5 states that owner operators [own authority] must conduct queries on himself...

    After 3 years of data is collected a motor carrier can stop asking the Drug and Alcohol questions on previous employment checks...

    Not every driver will go into the CDL Clearinghouse database. It will only include driver's information who have a drug or alcohol policy violation (refusal, positive drug test, etc.) When an employer performs a limited query, I will give them a 'yes' or 'no' answer. 'Yes' meaning, they do not have a record in the Clearinghouse and are eligible to hire. 'No' meaning, perform a full query to see their full record.

    An owner-operator (an employer who employs himself or herself as a CDL driver) is subject to the requirements pertaining to employers as well as those pertaining to drivers. Under the Clearinghouse final rule, an employer who employs himself or herself as a CDL driver must designate a consortium/third-party administrator (C/TPA) to comply with the employer’s Clearinghouse reporting requirements (§ 382.705(b)(6)).
