Truck dimensions

    Hi

    I'm an attorney in Washington State. I'm defending a driver who was accused of using his cell phone while at a stop light. State trooper says he pulled up next to the truck and saw the driver using his phone through the window.

    Troopers here drive some form of Ford SUV (I think explorers) so I know they are a bit off the ground. The driver was in a 2007 Kenworth Semi. Does anyone know how high off the ground the windows are on that truck? I think the trooper was fishing for a stop and made up the seeing the cell phone after the fact.

    I see truckers on their cell phones when driving my car nearly every time I'm on the freeway and I don't have a tall suv.

    A couple thoughts ....


    First is if the trooper pulled the truck over and gave the driver an inspection, he does not need a reason to pull the driver over, even if the only result was a cell phone ticket.

    Second is I can easily see into a truck at a low angle and have observed drivers texting or talking on the phone.

    Third, as much as I would take at face value that you are an attorney, disclosure of who you are would validate your questions.

    Why would a so called lawyer get on here to ask questions. You could very easily pick up the phone & call somebody that has one & get them to measure it after all Y'all are supposed to have all the knowledge to win any case.

    Plus, a lawyer would know a generic truck and guessing on the officers vehicle will do squat in a court. You need measurements from the actual vehicle models.
    I will tell you this, I sit on a camp folding chair at the warehouse at work and can see people talking on their phone in the truck next to me (parked in the dock), much less the one that if further away.

    Your better bet would be get the phone records from the phone company, unless you.. sorry, your client, was actually caught using the phone.

    Or better yet find and rent that model truck, go to Enterprise rent that model of SUV, Stick a pretend driver into truck wtih CELL and sit in the explorer yourself until you are satisied the real we
