Yes, if you have hours and are not claiming ro be ill or farigued then they can dispatch you to run off recap. The 34 reset is optional and does not have to be taken, it just makes managing hours of service simpler for most.

When I drove regularly I rarely ever took a 34, always have run recap since I started in 1990

34 is great for drivers who run 5 days a week and then are home.

That, by the way, is me.

    Hell with a 34. I usually do a 48-60hr reset lol.

Except this weekend. Gotta roll in 5hrs to make a 7am drop, then dh, reload and see if I can make it 7hrs back N.

34 is optional not a right. If you got the hours, you need to run them out.

You don't NEED to do anything... It's what the company (driver is secondary) wants to get done. But as the driver, you get to have some say in what you do as long as it's not unreasonable.

But to affirm the answer said above: Yes, if you have the hours and have not made arrangements for time off, then they can send you on a load; Providing that said load isn't going to violate your HOS. If you're home when time runs out, they may (or may not) care.

The only way the company will force a 34 hr reset is if you wont get enough hrs back to run a load, or broke down.
