It's a criminal act in CA.

6 months jail, usually summary judgement and fines. If you were say 10100 over axle then it's 2000 dollar base fine plus another $2020 added on. Total of $4020 for that offense. Then you probably will have court costs, fees added on. (Misdemeanor) if your incarcertion is in a private contracted Jailhouse then you will accrue a certain amount of dollars per day times 6 months Call it 150 dollars times 180 billable to you... 27000 dollars.

Either you are liable for this bill individually or the Government pays the prison for all the prisoners inside the place once a year as a form of subcontracting services out.

Also overweights lead to other things in inspection if it is sufficiently strong and detailed hunting for other violations. (And the fines to go with those as well as OOS potentially and sometimes even Arrests on the spot. Pot in the truck? Arrested. Because now it is a Federal Violation. Legality at the state level means nothing. One of my OO's was caught over weight to the tune of 6,000 pounds, plus it was a 53 ft lowboy (brand new) and too long for the king pin law.
He had to hire a truck to take the load to the state line and another truck to load and haul the trailer.
He also had to go back o court, with a lawyer, and no jail time was mentioned BUT the fine was 20,600 dollars.
It turns out it is against the law to sell a trailer in the state of cali that is not legal to run in the state, and against the law for the state to register it, which they had, when the lawyer pointed out all this, they dropped the fine to 500 bucks, but the lawyer told them to cough up the 55,000 that he had paid for the trailer, and they could have it back. This rocked on for a while and the state sent investigators to boise to make sure the trailer had not been altered, and finally just went away with no fine.

 

The penalties in CA aren’t as bad as what trucker legend would have you believe.
I was out there twice a week with a 52ft spread axle cattle trailer for almost a year and a half before I got a ticket. I got a police escort from Truckee back to the Nevada line and a fine of $137.

 

The way I understand it, it depends on which county you are caught in in cali as to how exorbitant the fines are, the only fine I ever got out there was a 3rd lane violation, and it was 360 bucks.
