So? What matters is what's written down in the guidance. An opinion piece, be it from director of FMCSA or even the PoTUS doesn't mean squat. What matters is the regs, which includes guidance.

 

Ohhhhhhh the director doesn't decide how the rules are interpretated. The FMSCA has no authority over the rules they make?

 

Sure he does, and once he publishes said rule you will be correct. Until then it's simply an opinion.

Oh, and he has to go through a whole "process" like getting public feedback and studies on how it will affect safety and such to publish along side the rule, he can't just make up something and say it's a new regulation.
