O/O want pay me my last 2 weeks check

    I just left from working for an O/O and he want pay me for the last 2 paychecks. I took him his truck back clean and I gave him notice I was quitting. He was all nice until I left and now he want pay me or answer my calls unless I tell him I'm getting a lawyer. Then he cusses and hollers how he's going to pay but he's going to deduct flight money and hotel money and orientation money.

    Dont get a lawyer. Its against the law for him to hold your pay or to make any deductions like that unless he has written permission from you or if you signed something when hired. All you have to do is call the labor and wage board and turn him in. Also, did he pay you on a 1099 or w2? If a 1099 but you used all his equipment and he told you what loads to haul then you are a company driver and a 1099 is illegal also, so you can add that to the complaint with the labor and wage board. Tell him all this and he will pay you without deductions Im sure since he doesnt want to be turned in.

    That’s what I’m thinking, don’t see the problem. The owner is deducting things that the driver should pay for, like flights home or am I missing something.

    If you are being paid on a W-2, then you should not have to pay for flights, hotel or orientation pay, as you're following direction and assignments as an employee. If you're paid on a 1099, then you're classified as an independent contractor (unless you can prove otherwise) and you need to take him to small claims court.

    Take whatever documents and evidence of employment that you have to a lawyer or your local labor relations board.
