Looking to talk about AB5 in California

    Congress was already talking about adopting the ABC test when Uber and Lyft didn’t go to their hearings a few weeks ago. This isn’t just about truck drivers, and it isn’t just about lease purchase deals, and people don’t realize that.

    And if you could save someone from entering into a terrible lease purchase on their own free will it’s not like they’re suddenly going to be financially responsible. They will find some other “easy” way to make big money to lose their money on.

    Sure it’s no big deal for a local dump truck driver to become an employee of their own LLC or even do a two check deal because they’re home. Once an OTR guy does the two check thing he immediately loses the ability to itemize on his taxes because he is now an employee driver again.

    And if this is such a great deal and such a good idea then why is CA already handing out exemptions from AB5 to a bunch of other industries?

    The law doesn't specify tax status or how you get paid ... 1099 or LLC it doesn't matter.

    There's even some confusion if you even have your own authority you won't be able to pull for a brokerage that has it's own trucks.

    Live in California. Message I rec'd from LS was I won't be able to pull loads out of ca after Jan 1.

    Evans network of companies is pulling out of California this month, they didn't have a lot of agents there but told them earlier that if this was to pass they would be pulling out.

    No need to email anything.

    One thought about that Bill and any associated type of legislation with one LOUD, CLEAR MESSAGE from California to ALL truckers.

    ESPECIALLY those who sign leases or are Owner Operators. The Message is this:

    "Who are you (The trucker) who dares do this kind of business. Who are you (The company) who dares take advantage of trucker?" All of you (trucker and trucking company) "GTFO" of California. You are not allowed to business in this State. Scram. Go away out of California, don't come back. Ever.

    Sooner or later that includes ALL truckers. If I examine TTR about that subject you will find many people decide that they will not get a CDL in California, they WILL NOT endure the BS legislation in California and they will NOT accept a persecuted life economically, legally or otherwise anywhere in Calforonia. Again the State's Positon is clear. Truckers Scram. Truckers go home. Truckers not welcome. Take your freight and shove it. Your money too.

    California wants ALL trucks to go away. And they are actually passing the beginning of a purge against trucking of a sort with the AB5 and similar Laws being passed and signed into law by the Governor. He cannot wait to get ahold of pens in both hands to sign these laws immediately.

    My position? You will recognize the southbound Grapevine on I-5 in my avatar from the fall of 1998. I have spent so much time coming and going from California it was almost a second home of sorts with many beautiful valley girls offering to see about making a family in our lifetime through some of the dinners we had together in that state. Some of whom are like me, not native to that state.

    I have said to them I live in a free state in the South. And I cannot abide or recognize the laws that California seeks to make and is actually making that is a persecution of truckers in the industry who dare go there to make money. Good money. PILES of money. A stinking lot of paychecks out of LA to Avenel NJ in my later years with loads that paid so much stinking filthy rich dollars that I would not want to run anywhere else. Like a grizzly standing over one of your rivers filled with Salmon trying to get past it.

    Well you have the bear on your Flag Mr California. You have forsaken what supported you before you were a State in freighting. Later in trucking. You are going to need a awful lot of choo choo trains full of your nuts, produce, meats, dairy products, candy and all sorts of stuff to roll it east without trucking. And you will learn there is not enough trains in all the world fast enough during harvest to keep up like we can in trucking. Therefore your crops will rot in the fields.

    And so your state will rot in time. And that will be a shame because the State house did it to themselves. No one else to blame. Sooner or later the USA will decide we don't need California. as long their state house continues downt he suicidal path of passing laws killing the very industries they have left to keep them in a good living.

    And for what? A dabble of green tech maybe? Your state is choking on it with the turbines that cover your mountains, trains that hardly smoke and your traffic that goes no where several hours per day tryingto get to work that produces nothing. And without trucking?

    Forget it.

    Thank god I live in a country that loves trucking and understands that if you stop the trucks hauling fuel, food and mission critical goods, you will not have America as we know it within a month it will be anarchy on a large scale.

    Everyone who has eyes are getting out of CA with their incomes, taxed incomes and other assets sold off and going out of the state of CA permanently. Sooner or later enough of the People will have left that CA will have nothing. Then they teeter on ruin.

    What a shame. All that waste and for what? Nothing at all.

    This will have a good chance of being removed in it;'s time if not myself also tossed from TTR for daring to speak what I consider to be a truth with these laws coming out against trucking in California in the light of day as they are written and passed very recently with more pending to be passed. It would be considered unwelcome political thought from me to speak of this this way it will hurt trucking. And ultimately hurt no one but California.

    It is because I love trucking and am enjoyed in my time the opperuthniites I have had with CA that were very good across the board. Literally a land of gold to me as it were.

    If I am gone after today and no one gets to see me again on TTR, that's why. And it will be something that would have to be done because it is not allowed to be truthful what CA is doing against trucking at large in general. And thus would not be allowed to be debated or discussed in general terms with CA or politics of any kind related specifically to damages against trucking by the laws passed designed to eliminate it.

    I expect myself to be eliminated as well. But in time the bare truth of what is going on with AB5 and other laws will be painfully apparent when the industry is destroyed in CA first.

    Don;t say I didn't tell you so. Because I wont be around to say I told you so.

    As of Jan 1st Schneider won't have any IC's in CA.
