    Hello I'm a newbie
    Got my class A in 2016
    Last few companies worked with had to take them to Labor board. I worked with company in Fontana he takes out money from driver's he calls it Escrow.
    owner says it's insurance for his trailers
    I worked with few truck owners
    Still trying to find great company to work with. Can't seem to get work
    Don't have much experience.

    Please do not take this personal because it isnt....but I confess that I am using your handle to point something out to you.....
    What does the regulation say about duty status ?.....
    You are not off duty unless you have been relieved of all responsibility related to the CMV which you operate.
    Attending it....loading unloading....waiting on bills or any documents.....anything....you are on duty by regulation. Post the reg. 395
    By regulation all time required of a driver to be even in a state of readiness standby is considered on duty.......
    So......what does every driver and every carrier in the nation do every day.....
    While attending tbeir vehicle in a state of readiness.....when freight is being loaded and unloaded ???????
    THEY ALL GO OFF DUTY !!!!!!!
    I even sleep SB at shippers and consignees.....whenever allowed and possible to avoid...starting my CLOCKS ......to get there.....and logging starts when I am dispatched to leave or forced to leave....
    Are you going to tell me that DOT FMCSA ....isn't aware that every carrier and its drivers violate this regulation everyday?
    LOL.....putting yourself in the sleeper SB....when you are required to be attending a cmv that is being laden or unladen with freight doesn't mean you are off duty. ......lol.....
    Log it legal ?.....really ?
    Come on.....impossible !!!
    Loading and unloading time standard industry allowance.....2 hrs each right?
    So.....many places you will sit an hour past appointment schedule before you get a dock/door call.....then they use their 2 hrs.....then they drag another .5 hr creating the bill or scaling on site or verifying downloaded count.....
    So....you have...potential of 3.5+ hrs on each end......plus whatever additional extra absurd detention they may have caused you to fight to document and collect pay for......ok
    So.....say I have a 7 AM live load and I get up at 0500 have coffee a grand movement throw a cap and boots on and stumble into the driver check in at 0600 hoping to get a door early and.....the 3.5 ....hr waiting game starts at 0700.....its 11....by the time I have secured my freight sealed it up and adjusted my tandems....for the weight and recorded the bill document in my log.....now....I am ready to pretrip and start my 14 hrs....of work at 11 AM ....so.....I can drive 11 hrs + I have a .5 dot break.....b4 8 hrs.....and say I fuel for 25 mins.....so.....thats 12 hrs and its......23:00....now......and I have been awake since.....05:00......which is.....
    18 hrs.....right....so its 23:00 and the rest areas are overflowed and nothing left. .....in the truck stops for parking so I go pc and drive the last 25 miles to the consignee.....because its the only place I can find parking right and its to my benefit because....I dont have to start my clock to deliver....I either put on duty unload 15 mins.....when I get there to park.....or....I wait till I am unloaded then put 15 mins " unload & pretrip after I have my next dispatch and my 10 hrs has passed for my rest break.....but wait a minute I never slept 10 hrs.....because its first come first serve so I spept 5 hrs......and got up at 0500.....and attended my vehicle waiting on dock call docking....unhooking. rehooking maybe.....planning my next route.....till 10.00. ....again......
    Off duty at shippers and consignees SURE....in the......SLEEPER 10 HRS.....
    SURE......only worked 14 hrs or only logged 12 maybe.....SURE.....
    YOU BET......because I am logging it legal.....while....I am working 19 hrs out of 24..... Because if I don't you are going to call me and ask why I didn't.
    Sure the lies look legal....they're logged legal......or are they?
    Because the reg. Says.....when every carrier has every driver at the dicks everyday "Attending the vehicle"
    They are.....ON DUTY.. .BUT....every carrier has every driver log it as OFF DUTY......
    And you think DOT/FMCSA are so stupid they dont know it?
    SURE......
    CAN YOU DEFINE THE MEANING OF COMPLICIT.....as it applies to prosecution?
    The whole Industry is culpable and COMPLICIT....
    And all dispatchers....log compliance safety personal.....DOT.....
    EVERYBODY.......KNOWS......
    But.....just log it legal .....AND GET R DONE!.... .how many other trades live like an APE IN A ROLLING CAGE....
    And work 19 hrs in 24 and operate 80K lb equipment safely w/o adequate rest under threat of imprisonment in a cage that doesn't. ROLL.....if something happens. ... but dont get in the four wheelers way or slow them down while you...are delivering everything they have and want and require to survive......
    Sorry.....really I apologize for the rant it isn't personal at all I don't know you.
    Just.....lol....your handle set me off.
    I always log my illegal work activities that are expected of me.....LEGAL
    Because if I dont....I get a message or a phone call or a fine or a failed inspection or a deposition or a prison sentence.
    What a wonderful vocation driving is I lLove it!..... You get to test your endurance patience and sanity almost everyday and fight for your compensation the rest of them!
    LOL
    But....tell me another vocation that pays better without a degreed education and is so heavily regulated.
    Apes in Rolling Cages....trained to execute according to regulations or suffer the consequences.....
    I won't pull a reefer or knowingly park next or near one.....I'll go pc and leave a truck stop.....because funny thing can't rest with the racket and can't hear the alarm with ear plugs in.....
    I tried it....not for me....won't drive team and bounce up and down and listen to drive axles whine either....and two people in the same cage is one too many!

    Hang in there and best of luck to you.
    Make sure all your driving is verifiable employment.
    As you accumulate more verified experience you will be able to demand increased pay.
    • I started at .25 a mile next job .40 and I am getting .65 now it took awhile....keep your record clean and don't abandon any cmv.

    That is why I post here. I want the company to know what evidence I have against them
    so I don't have to waste my time making a fool out of their representative at an unemployment
    hearing. I believe this forum is a good service for the driver.
