Seems to be a lot of misinformation. What is the legalities of only offering a 1099 instead of a regular W2?
Lots of people now in my opinion paying less then they should being that they are forcing self employment tax and all the other stuff on the driver.
What was the ramifications of the law of the recent ruling?
1099 or W2

Real trucking company pay on w2 the others like to say you are 1099 so you have pay their share of the taxes. If your driving their truck plus all the other stuff you an employee not independent contractor.

No resent ruling per se. Might have been another lawsuit about a misclassification, but that happens every few years. Thing is, for the most part 1099 is illegal except is some specific cases. Think of it this way. If they company is breaking the law as the very first act of hiring you by doing a 1099, what other laws are they willing to skirt around? And what will that do to your CDL when it all hits the fan?
You know those stupid regulations like truck maintenance and HOS and such.Tb0n3 Thanks this. -
I agree with all said, And I would not do 1099 myself, but I am seeing a LOT of places starting to do it, and really wondering why drivers are not filing suits against them.
12 ga Thanks this. -
1099 no employee pays work comp, med insurance, all 15% fed tax, plus new income tax that goes by income up to 30%. But you get daily per diem rate. So that's cool.
