Accident how much to Ask for PER DAY?

    I had to lawyer up for down time reimbursement.

    Its kinda funny,.. because they were a self insured mega company that bashed my truck and they said the same thing,.. $150 a day or a max of $750 for my down time is all they wanted to pay.

    I instantly lawyered up. The only down side is that it took over 1.5yr to collect. I followed through,.. I was dealing with 6 weeks of down time. Down time was based on a 3 month average of gross earnings. Then they wanted to nit pick about fuel and other expenses. Brought up not renting another truck to mitigate my down time. Anything they could to drag things out.

    In the end they paid,..plus paid lawyer expenses. And initially I was only asking for 50% of what my lawyers came up with after took my 3 month average. The mega scoffed and said that industry standard is $150 a day. I scoffed back and asked what kind of O/O runs a business off $150 a day?

    If they don't want to pay downtime, tell them to pay for a rental truck!

    You don't need to lawyer up. File a small claim. These cases have a maximum payout of $5,000 if you are filing against a business, but with no lawyer fees for you it's worth the $25 filing fee. If they don't show up, the judgement is in your favor, and interest accrues if they don't pay. They can appeal, but it will cost them more in attorney fees to fight it, and chances are they will settle.

    An insurance adjuster's job is to pay you the least amount possible. NEVER settle for their first offer. It's all negotiable.

    Yah I have insurance that covers a rental truck in these cases....my carrier requires us to rent a replacement to finish our loads ...but they have a national account we can use claims a 30 or 40% discount. I haven't verified the discount ( knock on wood haven't needed it yet)

    Problem is you are going to hit 5k in two to three weeks.

    Not sure which cases you are refering to. In my case we settled for $26k plus attorney fees.

    That was the same issue where I am leased with.

    I sent the same copy of my contract 3 times before they finally read that part.

    The entire process is frustrating and time consuming. I'm guessing that is their tactic to wear you down.
