Another Driver Placed OOS By The Feds

    Wow man the balls....I only had one OOS ( oversize permit wasn't right had to wait til morning) and I can't imagine just saying F it and rolling.

    So what happens if you do? What happens if you don't pay fines? Will any agency just tow your rig and send you walking? Why do I try so hard to do everything correctly and then read all of these people doing it illegally and making just as much money for just as many years and not even carrying insurance or even having a CDL!!?

    Table 1 to §383.51 #7 has that covered, as well as the "subsequent offenses" part of Table 4 to §383.51. Just keep telling them they can't, shut 'em down when they do, and then catch 'em again next week to DQ them for another period of time, which they'll ignore as well.

    I suppose if EVERY instance of a driver violating an OOS or getting caught driving while DQ triggered an audit at the carrier level, it would probably do more to stop these sorts of drivers...can't drive a CMV if nobody will give you the keys...and nobody is going to hand over the keys to anyone who will likely get the feds using a fine-tooth comb as they look over driver qualification files, RODS, IFTA, etc...fines for what would be far more than what little profits that driver may have earned while he was there.

    Nothing in the federal regs allows imprisonment for violating OOS or DQ. State laws may vary, though...

    This shows what drivers will do because they don't think they are tired or anything. All they care about is money.

    Look at all the times he could have stopped and should have stopped. Now he will probably go to prison for a long time.

    And as I said before,Kansas hit him with involuntary manslaughter charges so he’s already looking at prison time.

    Those charges are because the worst of the worse happened...fatality wreck. If you're just stopped for a random, speeding, marker light out, didn't signal a lane change, etc., then you aren't going to face any jail time. Of course up until the point where this guy crashed, he probably didn't think he would...you just never know. The less "legal" you are, the greater the likelihood of criminal charges IF you wreck and injure/kill somebody. Even if you're 100% by-the-book legal, you still might get that overzealous prosecutor up for election trying to make a name for himself as someone "tough" on those law-breaking truckers.
