Broker Says I delivered late..

    A picked up and delivered a load that was given to me by Dispatch from a certain broker. The broker paid me $4,500 in cash and stated that he would submit the remaining $500 to the next driver. I had him son a rate con and how the signed bill of lading. Can he legally deduct $200 from a sign rate con stating that I was late?

    If you or your driver was late, and it was in the rate con, signed contract, then yes, he can.
    If you weren’t late, then no, he can’t.

    Legally it depends on what is in the contract you both signed.

    if your driver is going to be late, and you signed and he (the broker) signed a contract, then your beef is with your driver, who cannot seem to keep appointment times.

    With the caveat that the driver was given a legal appointment time to begin with, which, unfortunately, cannot be assumed.

    Do you have anything with a date and time stamp that was either signed or electronic at time of delivery?

    Here’s where a ELOG shines . It proves that you were there at a certain time . Whether that is the correct time is between you and the broker .

    I had many on time deliveries to make to Ollies. When I arrived at my destination, my Elog would come on and ask if I was there. I had to respond. This removed all doubt.

    First were you or your driver late? Second, if it is stated in your conformation that you would be charged $200 if you were late, then yes. When you signed the rate confirmation, you agreed to this.
