The company I work for is trying to tell me when and where I should take my 30 minute break, nethier of which is agreable to me. I do a lay down run. So essentially go to the same places on a given day and do the reverse the next day. They want me to take a break at their terminal in a particular city, which has no food options beyond a vending machine.
Can they legally do this, or per the FMCSA can I take my break when I see fit as long as it's before 8 hours of On Duty time?
Can a carrier tell you when and where to take your 30 minute break?

They can not dictate to you where or when you take the brake as long as you take a legal break at a legal location.

There is no stipulation in the HOS saying where it has to be taken, and no you're company cannot tell you where to take it. Today I had five stops and I decided which stop I would log as my break. Surely the run isn't so tight that they don't want you taking a few extra mins to find somewhere else besides the terminal.

I say they can. Its simply a company policy. Its an inter-company issue. There is NO rule from FMCSA that says they cant. Again, this is a company policy just like any other inter-company policy. Where to buy fuel, where to leave your truck when on your days off, when to report in on a daily basis for example, etc, etc. As long as they are not violating a written rule or law, they can set any policy they choose inter-company.
